Freedom of Information Request - Third Party Consultation
I refer to your request dated 2 November 2016 and received by the Department of Human Services
(the department) on the same date, for access under the
Freedom of Information Act 1982 (the FOI
Act) to the following:
'With respect to the pay rise recently announced for SES staff, I seek all relevant documents
which address compliance with the Workplace Bargaining Policy 2015.
I also seek any documentation which details any productivity or productivity-related
measures linked to the SES pay offer, in addition to any documentation where approvals
were sought from the person authorised to grant the payrise'.
Third-party consultation - documents affecting personal privacy
As your request covers documents which contain the personal information of other people, the
department is required to consult with those individuals (under section 27A of the FOI Act) before
making a decision on the release of those documents.
For this reason the period for processing your request has been extended by 30 days in order to
allow the department time to consult with that individual (section 15(6) of the FOI Act).
The consultation mechanism under section 27A applies when the department considers the
individual (or their representative) may wish to contend that the requested documents are exempt
for reasons of personal privacy. The department will take into account any comments we receive
from the individual. However, the final decision about whether to grant you access to the
documents you requested rests with this department.
