Department of the Prime Minister and Cabinet (the Department), in which
you made a request to the Department under the Freedom of Information Act

The Humanitarian Overseas Service Medal has been awarded to Australians
from General Electric Infrastructure, Water and Process Technologies; and
Aspen Medical Pty Ltd.

I respectfully seek the Department’s assessments for public review
justifying the award of the medal to these commercial contractors

 

Timeframe for receiving your decision

 

Your request was received on 1 September 2020 and the 30 day statutory
period for processing your request commenced from the day after that date.
You should therefore expect a decision from us by 1 October 2020. The
period of 30 days may be extended in certain circumstances. We will advise
you if there is any extension of time.

 

Charges

 

Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the Department decides that you
are liable to pay a charge, we will send you a preliminary assessment of

below Chief of Staff.

I do apologise for the grammatical error in my original FOI request(The Humanitarian Overseas Service Medal has been awarded to Australians from General Electric Infrastructure, Water and Process Technologies; and Aspen Medical Pty Ltd. I respectfully seek the Department’s assessments for public review justifying the award of the medal to these commercial contractors').

I mistakenly did not insert a comma which may have led to the confusion.

Therefore in order to clarify the matter, I was not seeking a document titled 'Department’s assessments for public review'.
I was seeking the Departments assessments in order that we the public may review them.

Accordingly, I respectfully ask again for the following documents under FOI.

I refer to your email dated 2 October 2020, received by the Department of
the Prime Minister and cabinet (the Department) in which you made a
request under the Freedom of Information Act 1982 (the FOI Act) in the
following terms:

 

I seek the Department’s assessments justifying the award of The
Humanitarian Overseas Service Medal to Australians from the following
commercial contractors General Electric Infrastructure, Water and Process
Technologies; and Aspen Medical Pty Ltd.

 

Extension of the processing period

 

As your request covers a document which concerns relations between the
Commonwealth and a State Government, the Department is required to consult
with that State Government (under section 26A of the FOI Act) before
making a decision on the release of the document.

 

For this reason, the period for processing your request has been extended
by 30 days in order to allow the Department time to consult with the State
Government (section 15(6) of the FOI Act). The processing period for your
request will now end on 1 December 2020, subject to any other extensions
or suspensions of time under the FOI Act.

 

The consultation mechanism under section 26A applies when we believe a
State or Territory may wish to contend that the requested documents are
exempt because their release may cause damage to relations between the
Commonwealth and a State or Territory Government or may divulge
information communicated by that Government in confidence (section 47B of
the FOI Act).

 

We will take into account any comments we receive from the State
Government but the final decision about whether to grant you access to the
documents you requested rests with the Department.

Respectfully, we would like to ask for an internal review internal review of Department of the Prime Minister and Cabinet's handling of my FOI request 'Humanitarian Overseas Service Medal: Seeking assessment justifying awards to commercial contractors'.

Regarding document "ref B09/1640 HOSM: Assessment of Australian contingent to GE Infrastructure for 'Indian Ocean’ operation”.

Attachment B was not disclosed and we would be grateful for a copy of that document. We understand some material may be conditionally exempt and will be happy to receive a redacted version.

Attachment C refers to “(s47F redacted) were hired by an international corporation to assist with the delivery of a gesture of good corporate citizenship”.

We would like to ask for a copy of the documents related to, or identifying the international corporation.

the Department’s decision in relation to your FOI request.

 

We write to provide information regarding the identity of the
‘international corporation’ referred to in Attachment C to document
reference B09/1640 and, in the light of that information, to seek
clarification of the scope of your internal review request.

 

In relation to the identity of the ‘international corporation’ referred to
in Attachment C, we understand that the international corporation is GE
Infrastructure, Water & Process Technologies.

 

In light of the information about the identity of the international
corporation, we seek your confirmation that the scope of your internal
review request is limited to a review of the Department’s decision not to
disclose Attachment B to document reference B09/1640 (Document 1 in the
Department’s decision)?

We can advise that the Department’s decision on Attachment B was that it
was not within the scope of your FOI request and therefore was redacted as
irrelevant information under section 22 of the FOI Act.

 

If the scope of your internal review request is not limited to the
Department’s decision on Attachment B to document reference B09/1640,
please provide more information about what you wish to have reviewed.

Thank for for clarifying things, please disregard my earlier questions about Attachment B.

The remainder of this clarification regards Attachment C.
On the attachment’s 3rd page the author states:“( s47F ) were hired by an international corporation to assist with the delivery of a gesture of good corporate citizenship.”

I respectfully request access to the information conditionally withheld via the s47F exemption above.

I do understand that the s47F exemption is intended to protect the personal privacy of individuals, however I do not seek personal names or contact details. My understanding is that for particular information to be personal information, an individual must be identifiable or reasonably identifiable and that the FOI Act holds that an individual is a natural person and does not include a corporation, trust, body politic or incorporated association.
