The Department of Veterans’ Affairs (the department) has received your

Your request was received by the department on 16 July 2022 and the
ordinary 30 day statutory period for processing your request commenced
from the day after that date.

 

Extension of Time

Due to an increase in the number of information access applications
currently being received by the department, we are asking your agreement
to an extension of time for a further 30 days to process this request
under section 15AA of the FOI Act. This would mean that your request is
due on 14 September 2022.

 

If we are in a position to make a decision on your request earlier than
this date, we will endeavour to do so.

 

The statutory period may also be extended if we need to consult third
parties or for other reasons permitted under the FOI Act. We will advise
you if this happens.

 

Please reply by return email if you agree to this extension of time. If
you do agree we will notify the Office of the Australian Information
Commissioner (OAIC) of your agreement under section 15AA of the FOI Act.

Dear INFORMATION.ACCESS,

This foi requested a document that has been routinely released by DVA under FOI and is not novel or unusual.

It is produced entirely by an reporting command from DVA's computer system and involves no search activity or any consideration of exemption/redactions because it simply an update on the series of these previously released position reports.

On checking the Office of the Australian Information Commissioner Guidelines, it states that foi agencies are expected to cope with temporary surges by using available resources that large agencies such as DVA have to comply with the 30 day processing period

Taking into account the minimal effort involved in producing this foi request (given it is a regular foi request now, able to be produced entirely by computers available to DVA, with no search activity involved or any novel exemptions to consider) it is not appropriate to agree to an additional 30 day
section 15AA FOI Act extension of time.

I have also taken DVA's history of misusing such extension of time in the past in determining that a section 15AA FOI Act extension of time is not justified in these circumstances.

This invalid substituting of the scope of my request did not come from me, and did not have my consent.

Internal review is only available on a decision made and is not available
on the 'handling' of a request. Therefore, this request for internal
review is invalid and as such the department will not review the handling
of the decision.

 

Background:

 

This request relates to LEX 47363 made by Ms Verity Pane seeking:

 

"I previously obtained a position tree report for the Legal Branch of DVA

I seek the same report but this time for those areas of DVA that are
responsible for veteran MRCA/DRCA/VEA liability and compensation
processing/assessment. I wish to understand how many positions at DVA are
involved, and the extent of their distribution (state/territory location,
aps/contractor, employment level)."

 

 

And LEX 50843 requested:

The information previous provided was limited the MRCA/DRCA liability and
compensation processing/assessment, whereas, LEX 50843 request was for a
‘decision tree’ of the entire department. Therefore, the information
request is far broader in scope and is not an update of the LEX 47363.
