Dear Mr Shepherd
Freedom of Information Request 181-2022 – Acknowledgement
I refer to your request dated 27 September 2022 under the Freedom of
Information Act 1982 (FOI Act) in which you seek access to documents in the
possession of ASIC.
Your request seeks access to the fol owing:
Any and al documents and correspondence (both internal and
external) relating to Parkinson’s NSW Limited (ABN 93023603545) and its
conduct as a registered company under the Corporations Act 2001.
This includes but is not limited to the fol owing cases; CAS-66553-
X6J0M7 & CAS-71706-M7N5S9.
The purpose of this letter is to acknowledge your FOI request. However, I also
draw your attention to section 12(1)(b) of the FOI Act. This section sets out
that the FOI Act does not apply to documents that are already publicly
available, as part of a public register or in line with an enactment where a fee
or other charge might apply. Many of the forms that fit within the scope of
your request, can be purchased from: https://connectonline.asic.gov.au/
Some of the documents you have requested are emails between you and
ASIC in relation to CAS-66553-X6J0M7 and CAS-71706-M7N5S9 which you likely
already have a copy of. Please confirm by email if you agree to removing
the fol owing documents from the terms of your request:
Emails from xxxxxx.xxxxxxxx@xxxxxxx.xxx in relation to CAS-66553-
X6J0M7 and CAS-71706-M7N5S9
Emails to xxxxxx.xxxxxxxx@xxxxxxx.xxx in relation to CAS-66553-
X6J0M7 and CAS-71706-M7N5S9
As your request was received by ASIC on 27 September 2022 and the 30-day
statutory period for processing the request commenced on the day after the
date of receipt, you should therefore expect a decision to be made by 28
October 2022.
2
The 30-day processing period may be extended should ASIC find it is necessary
to consult third parties, where a charge is to be imposed on the processing of
the request or for other reasons. You wil be advised if there are changes to the
30-day processing period.
Please note that any documents released to you under the FOI Act may later
be published online on the ASIC disclosure log in line with our obligations
under the FOI Act. This requirement to publish released documents is subject
to certain exceptions for example, personal or business information wil not be
published where it would be unreasonable.
If you have any questions, please contact me by email at
xxxx.xxxxxx@xxxx.xxx.xx
Yours sincerely,
Lisa Grealy
