Dear Ms Gibbs,

Transfer of freedom of information request to another agency

 

I refer to your request under the Freedom of Information Act 1982 (FOI
Act) for access to documents relating to the amount of medical marijuana
grown for medical trials. Specifically, you sought access to:

“a document identifying the amount of medical marijuana being grown in
Australia for use in medical trials from January 2015 to present”

 

I am writing to tell you that I have transferred the entirety of your
request to the Department of Health. Under section 16(1) of the FOI Act, I
am able to transfer a request if the requested document is not in my
possession but in the possession of another agency or if the subject
matter of the document is more closely connected with the functions of
another agency.

Accordingly, on 6 April 2016 I transferred your request to the Department
of Health, whose functions are more closely connected to the subject
area. 

We received your request on 31 March 2016 and the 30 day statutory period
for processing your request commenced from the day after that date.  The
Department of Health will treat your request as though it received it the
same day that we did.  You should therefore expect a decision from the
Department of Health by the next business day after Sunday 1 May 2016. 
The period of 30 days may be extended if the Department of Health needs to
consult third parties or for other reasons.  They will advise you if this
happens.

I refer to your email of 31 March 2016 to the Attorney-General’s
Department (AGD), seeking access under the Freedom of Information Act 1982
(FOI Act) as follows:

 

‘a document identifying the amount of medical marijuana being grown in
Australia for use in medical trials from January 2015 to present’.

 

Your request has been transferred to the Department of Health (Health)
under Section 16 of the FOI Act, from AGD.

 

Your request will be processed in accordance with the provisions of the
FOI Act, under which, Health is required to take all reasonable steps to
notify you of a decision not later than 30 calendar days after the above
receipt date.

 

In the case of your request, the due date for a decision is 30 April 2016
unless the 30 day period is extended, you will be advised should this
occur and provided with more details at such time.

 

The time period may also be extended with your written agreement.
