Advice or instructions to agencies regarding EA ballot data that allows possibility of unfair advantage to agencies in enterprise bargaining

James Smith made this Freedom of Information request to Australian Public Service Commission

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was partially successful.

Dear Australian Public Service Commission,

This is a request for information under the Freedom of Information Act (Cth).

My previous FOI requests to a various APS agencies have revealed that some agencies have used employee enterprise bargaining ballots to 'profile' votes by demographics such as APS level, office location (eg the physical office, or perhaps more broadly the state), and business area (or similar).

It is obvious that such profiling of votes is useful intelligence to agencies during the enterprise bargaining process, the availability of such information giving an unfair advantage to APS agencies as employers.

Agencies who have profiled voters in such a way include:

Australian Taxation Office
Australian Bureau of Statistics
Department of Immigration and Border Protection
Department of the Environment and Energy
Department of Employment
Department of Industry

I request any documents sent to any of the above APS agencies which give a direction, suggestion, or advice to consider, that agencies use any of APS level, office location, or business areas (or similar) in their enterprise bargaining ballots.

Yours faithfully,

James Smith
