Thank you for your email regarding a Freedom of Information enquiry
relating to potholes on Kent Street, Karrawarra between 1.9.2016 and
19.10.2016.

 

I sincerely apologise you did not received a response to your initial
enquiry, in order to assess your request and make a valid determination
under the Freedom of Information legislation you are required to submit a
valid Freedom of Information application, below is an explanation of the
Freedom of Information process.   Please ensure you state the date range
of the correspondence require as detailed in your email subject line being
1.9.2016 and 19.10.2016 and a phone number should we need to discuss your
application with you.

 

 

The Freedom of Information Act 1992 gives you the right to apply for
access to information held by Local Government agencies Local Government
agencies.

 

How to Make a FOI Application

All requests must be made in writing and be accompanied by an application
fee of $30.00.

 

In order for your application to be considered valid under Section 12 of
the Freedom of Information Act 1992 the access application has to –

(a)        be in writing (by mail, email or facsimile),

(b)        have enough information to enable the requested documents to be
identified (clearly described the documents being sought);

(c)        give an address in Australia to which notices under this Act
can be sent, your name and contact number(s);

(d)        what form the documents are required (eg. copy or inspection);
and

(e)        be lodged at an office of the agency with any application fee
payable under the regulations.

 

Or you can make a request using the attached application form.

 

 

Fees and Charges

As set out by the Freedom of Information Regulations.

Application fee for non-personal information $30.00
Staff time dealing with application, supervised $30.00 per hour
access, photocopying, transferring information
from tape or other device, etc. (per hour, or pro
rata for a part of an hour)

 

Plus the actual additional cost of the agency of
any special arrangements e.g. hire of facilities
or equipment
Photocopies (per A4 copy) $0.20
A0 to A3 (large format reproduction) $ Value based on A4 cost
Duplicating a tape, film or computer information $ Actual cost plus GST
Delivery, packaging and postage $ Actual cost plus GST

 

 

Advance Deposits

Section 17(3) of the Act provides that where an agency estimates that the
charges for dealing with an application might exceed the prescribed fee,
the applicant is to be notified of the estimate before such costs are
incurred.

 

Should the applicant then wish to proceed with the application, the agency
is authorised by section 18(1) of the Act to require payment of an advance
deposit equal to 25% of the estimated charges.    Should a greater amount
be required to progress the application, the agency may require, by
written notice the payment of an advanced deposit of up to and including
75% of the estimate charges.

 

Upon receiving a valid FOI application, an estimation will be made based
on the information provided by the applicant, the available resources
within the Town to process the application and the charges listed above.

However, the Town reserves the right to alter these estimated charges as
more information about the application is learnt over time.    Any
alterations will be in the spirit and intent of the FOI Act and will be
made at the lowest possible cost.

 

Please be advised that your application will not proceed until your
application fee of $30.00 is received.    Payment can be made by cheque or
credit card but payment by credit card must be in writing providing
written authority to deduct the sum of $30.00.

 

 

Timeframes

Under the Act, the Town has 45 days from receiving a valid application to
make a decision on whether to release the document(s).    However, every
effort will be made to deal with the application in an efficient manner so
that you are advised of the outcome as soon as possible   You will be
notified of the Town’s decision in writing.

 

 

Appeal and Review

When you receive a decision about your request you’ll be advised of your
rights to seek and internal review of the decision.
