Dear Department of Economic Development, Jobs, Transport and Resources,

I wish to request from your office all documents, including meeting notes, campaign, expert advice, financial records, communications material between other government departments, research and community survey data, relating to the compulsory acquisition at 320 Reynard St, Pascoe Vale South for the proposed tram substation project, please. The compulsory acquisition is said to have taken place on the 8th of October 2019. My request refers to all documents between June 2019 to current.

I refer to your request under the Freedom of Information Act 1982 (FOI
Act) received by the department on 25 October 2021 seeking:

 

I wish to request from your office all documents, including meeting notes,
campaign, expert advice, financial records, communications material
between other government departments, research and community survey data,
relating to the compulsory acquisition at 320 Reynard St, Pascoe Vale
South for the proposed tram substation project, please. The compulsory
acquisition is said to have taken place on the 8th of October 2019. My
request refers to all documents between June 2019 to current.

I am writing to request an internal review of Department of Economic Development, Jobs, Transport and Resources's handling of my FOI request 'All documents relating to the proposed tram substation at 320 Reynard St, Pascoe Vale South'.

I am requesting information which should be made public especially when taxpayers' money is used to fund a project and no transparency or information is being provided. The Department you refer to in within your department which I am being misled to feel as though it is a separate department. This is what I refer to as gaslighting behaviour which government bureaucrats should not be engaging in.

The Department of Jobs, Precincts and Regions (DJPR) is not responsible for the type of documents and I suggest you direct your FOI request to the Department of Transport. I have confirmed with this agency that they are the appropriate agency to direct your request to.

I believe your reference to s17 (2) of the Act is not applicable and shall not a valid reason to refuse such request.

I believe these documents requested should be supplied as a way of transparency so that the public can better understand the proposed project that is taking place. My administrative request is part of my right to access these documents under s11 of this Act.

Further to this, I believe your obligations are also set out under the Project Development and Construction Management Act 1994.

Your lack of cooperation and willingness to provide such information raises some serious questions.

Again, I do not ask for personal information. I'm simply requesting general information relating to the proposed project at 320 Reynard St, Pascoe Vale South where there seems to be a lack of information made publicly.

Please note that DEDJTR no longer exists. On 1 January 2019, the former DEDJTR separated into the Department of Jobs, Precincts and Regions and the Department of Transport.
