Dear Australian Sports Anti-Doping Authority,

I would like to make the following requests under FOI legislation:

A spreadsheet of how you made the investigation into Essendon Football Club

Documentation connecting Manly Sea Eagles and use of Pigs blood, and i would like a spreadsheet and audio/video revealing evidence of doping occurrences

Documentation linking Stephen Dank's files to his practice of using performance enhancing drugs, peptides to sports players

documents dated on the 26th May 2011 showing evidence that Sandor Earl trafficked peptide CJC-1295.

I would like a list of all peptides and drugs that are banned in Australian Sport

Dear Mr Mullens,

 

I refer to your email dated Friday 5 June 2015, in which you sought access
under the Freedom of Information Act 1982 (Cth) (FOI Act) to:

 

“A spreadsheet of how you made the investigation into Essendon Football
Club

Documentation connecting Manly Sea Eagles and use of Pigs blood, and i
would like a spreadsheet and audio/video revealing evidence of doping
occurrences

Documentation linking Stephen Dank’s files to his practice of using
performance enhancing drugs, peptides to sports players

I would like a list of all peptides and drugs that are banned in

With respect to your Request, we believe that the following aspects of
your Request are ambiguous:

 

1.       A spreadsheet of how you made the investigation into Essendon
Football Club

2.       Documentation connecting Manly Sea Eagles and use of Pigs blood,
and i would like a spreadsheet and audio/video revealing evidence of
doping occurrences; and

3.       Documentation linking Stephen Dank’s files to his practice of
using performance enhancing drugs, peptides to sports players.

 

We kindly request that you provide us with further clarification as to
what documents are covered by those aspects of your Request?

 

In relation to your request for “a list of all peptides and drugs that are
banned in Australian Sport” can you please clarify whether you are
referring to the World Anti-Doping Code 2015 Prohibited List?  I note that
the current list (and its prior revisions) are available here:

Once we receive clarification from you in relation to the above aspects of
your Request, we will be in a position to formally acknowledge your
Request.

Dear Mr Mullens,

 

I refer to my email of 15 June 2015 (below) seeking clarification of the
documents you were seeking under the Freedom of Information Act 1982 (Cth)
(FOI Act). 

 

As outlined in my email below, in order for your request to be valid, it
must (amongst other things) provide such information concerning the
document as is reasonably necessary to enable a responsible officer of the
agency to identify it (subsection 15(2)(b) of the FOI Act). You have not
responded to our email and we do not consider that your original request
provides sufficient clarity to enable us to identify the documents you
seek.  Accordingly, pursuant to section 15 of the FOI Act, your request is
not valid and we will not process it.

 

You are of course welcome to submit a new FOI Application. However, should
you choose to do so, we will treat that application as a new request and
process it accordingly.

 

If you require any further clarification, please do not hesitate to
contact me.
