Dear Sydney Trains,

I was assaulted at St Leonard’s on 2nd October at 6:01pm by the guard in the rear carriage of the train passion the station. I am aware there is significant footage of this event and would like all CCTV evidence relating to this event.

The reference number is Incident Information Management Systems (IIMS) Incident Number 00090 of 2 October. There's also what's known as a REM reference: 2019041766.

There is also police reference E71704609

Hi Craig,

The request has been sent to the Sydney Trains’ Security Monitoring Facility to retrieve the information.

Once the request for CCTV footage is located, you will be contacted by email and requested to apply for the information formally under the Government Information (Public Access) Act (2009) (GIPA). A fee of $30 needs to accompany the formal application.

Upon receipt of your access application, agencies are required to decide an access application within 20 working days of receiving the application (subject to any suspension or extension required).

Please note access to CCTV footage, provided by TfNSW, is reviewed under the GIPA Act. Most requests for CCTV footage are released as “Viewing Only”.

If you require a copy of the CCTV footage for legal proceedings, a subpoena will be required.

A search has been undertaken by the relevant area of Sydney Trains and the footage for the timeframe of your request has now been preserved that may be relevant to your request.

Next Steps

Please follow one of the following means of requesting access to the CCTV:

•The NSW Police can request a copy of the footage via IASK. If they are unable to do so, please advise them to direct their enquiries to this office

•If the matter is for court, please submit a Subpoena to the relevant agency and advise the legal counsel of the above reference number.

•Should neither of the above apply, or you wish to apply to view the CCTV footage, you may apply for access to the information through a formal application under the Government Information (Public Access) Act 2009 (GIPA Act).

Please note: Applications under the GIPA Act are considered on a case-by-case basis and in some circumstances (where there is an overriding public interest against doing so) access is not provided to the applicant.
