Briefing materials for Budget Estimates

We're waiting for Velan to read recent responses and update the status.

I request access to any and all briefing documents prepared for the Australian Public Service Commissioner for use at Budget Estimates (which took place in late March/ early April 2022) relating to the Commonwealth Ombudsman's decision to investigate the manner in which Kate McMullan conducted an investigation into allegations of wrongdoing by senior members of the staff of the Federal Court under the Public Interest Disclosure Act 2013.

I am writing to request an internal review of Australian Public Service Commission's handling of my FOI request 'Briefing materials for Budget Estimates'.

The documents you have provided appear to be identical to the briefing documents that Mr Woolcott relied on during the February 2022 round of estimates, which was not Budget estimates.

Budget estimate took place in the first week of April 2022. It would be embarrassing if you are suggesting that Mr Woolcott relied on the same set of briefing documents that he relied on for the February 2022 round of estimates, particularly when journalists at The Australian published, on 29 March 2022, fragments of correspondence from the Office of the Commonwealth Ombudsman noting that a "Category 4" investigation had commenced on or about 21 March 2022 into the PID investigation Ms McMullan had conducted. Surely briefing materials incorporating that update (specifically, that the Ombudsman had ended its preliminary inquiry under section 7A of the Ombudsman Act because a decision was made to investigate the APSC under section 8 of the Ombudsman Act) would have been prepared for the Public Service Commissioner.

I will give you a chance to search for briefing documents that would have contained accurate and up-to-date information on them. It would have been negligent for the Public Service Commissioner to advise Senators that a preliminary inquiry was underway when, in reality, the preliminary inquiry had ended and an investigation under section 8 of the Ombudsman Act had commenced (and been immediately escalated to "Category 4", the second most serious category of investigation).
