Consultations conducted with Kerryn Vine-Camp and Jonathan James Palmer under s 27A of the FOI Act

Dear Federal Court of Australia,

On 20 February 2022 I sent an FOI request to the Federal Court through this website - https://www.righttoknow.org.au/request/c...

On 28 February 2022 Registrar Claire Hammerton Cole acknowledge receipt of my FOI request. In her acknowledgement letter the Registrar stated:

Your request seeks access to documents that contain personal information about individuals. It appears that the individuals concerned might reasonably wish to contend that the documents are conditionally exempt under section 47F of the FOI Act and access would, on balance, be contrary to the public interest under the FOI Act. In accordance with subsection 27A(3) of the FOI Act, the Federal Court of Australia (Court) must give those individuals a "reasonable opportunity to make submissions in support of the exemption contention" before making a decision on the release of documents that contain personal information about the individuals ... For this reason, the Court has determined that the requirements of s 27A of the FOI Act make it appropriate to extend the period for processing your FOI request by a further period of 30 days in accordance with subsection 15(6) of the FOI Act.

The processing period for your request will now expire on Thursday 21 April 2022.

As it turns out, the "personal information" on the documents that were granted access to (certifications of SES selection processes) were the names and signatures of Kerryn Vine-Camp and Jonathan James Palmer.

In the light of the case law referred to in the FOI Guidelines, it was not appropriate for Registrar Hammerton Cole to extend the the processing period and what she did was not "in accordance with subsection 15(6) of the FOI Act)". In my opinion Registrar Hammerton Cole abused processes available under the FOI Act to delay a decision.

Under the FOI Act I request access to the following documents:

a) any and all documents recording consultations with Kerryn Vine-Camp in relation to the certification documents for the selection processes relating to the SES Band "National Judicial Registrar & District Registrar - QLD" and "National Judicial Registrar & District Registrar - WA" roles in the Federal Court;
b) any and all documents recording consultations with Jonathan James Palmer in relation to the certification document for the selection process relating to the SES Band 2 Senior Registrar role in the Federal Court.
