Contract: CN3418114-A2

John Smith made this Freedom of Information request to Attorney-General's Department

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was successful.

Dear Attorney-General's Department,

I request a copy of the contract associated with Commonwealth tender ID CN3418114-A2, between the Attorney General's department and Julian T Brophy.

Given the unusually large amount of money paid for a procurement of this nature (the largest PR contract paid for by the dept to date), I ask that a public interest in the transparency of this matter be recognised; and the ordinarily applicable FOI fees be waived in this instance.

Yours faithfully,

John Smith

Jones, Adam, Attorney-General's Department

Dear Mr Smith

Freedom of Information Request FOI20/070

I refer to your request under the Freedom of Information Act 1982 (FOI
Act) for access to a “copy of the contract associated with Commonwealth
tender ID CN3418114-A2, between the Attorney General's department and
Julian T Brophy”.

If you disagree with this interpretation of your request, please let me
know in writing as soon as possible.

The department received your request on 21 May 2020 and the 30 day
statutory period for processing your request commenced from the day after
that date. You should therefore expect a decision from us by 22 June 2020.
However, the period of 30 days may be extended if the department needs to
consult third parties or for other reasons. We will advise you if this
happens.

Where the documents within the scope of an FOI request include the
personal information of junior officers of the department or other
government authorities, the department’s practice is to not disclose that
information (e.g., names, contact details). The names of senior officers
will generally be disclosed. In addition, duplicates and incomplete email
chains within the scope of the FOI request will be excluded.

Please note that, with some exceptions (such as personal information),
documents released under the FOI Act may later be published online on the
department’s disclosure log
http://www.ag.gov.au/RightsAndProtection....

If you have any questions, please contact me by telephone on
(02) 6141 6666 or by email [AGD request email].

Yours sincerely

Adam

Dear Mr Smith

Freedom of Information Request FOI20/070

I refer to your request under the Freedom of Information Act 1982 (FOI
Act) for access to documents.

The purpose of this email is to advise you that the period for processing
your request has been extended by 30 days to allow the department to
consult with one or more individuals pursuant to section 15 of the FOI
Act.

The new date for the completion of your FOI request is 22 July 2020.

Your FOI request covers documents that contain another individual’s
personal information. Section 27A of the FOI Act requires the department
to consult with such individuals before making a decision about the
release of those documents.

This consultation mechanism is used when the department believes an
individual or their representative may wish to contend that the requested
documents are exempt for reasons of personal privacy. Please note that,
while the department will take the comments of the relevant individual
into consideration, the department will make the final decision regarding
access to the relevant documents.

More information is available on the Office of the Australian Information
Commissioner’s Website. FOI fact sheet 16:  Freedom of information –
Extensions of time can be accessed here:

Dear Jones, Adam,

I seek internal review of this decision 1-LK3Q49L.

The information regarding this contract on AusTender does not disclose any details regarding this contract, other than the identity of the service provider and the $ amount of the tender.

Given the amount of money associated with this tender ($2M), the public interest is not discharged merely by the information already available on AusTender. I seek that this decision be reviewed and that more details regarding the contract are provided.

What is the point of the FOI act if the most basic information about the procurement of services is out of bounds for inquiry by the public?

Yours sincerely,

John Smith

Dear Mr Smith,

I refer to your FOI request to the Attorney-General's Department. We
provided you with a decision letter in relation to your application on 15
July 2020. In that letter we indicated that a third party had 30 days to
decide whether they wished to appeal the decision to release a redacted
document. The third party has not appealed. Please find the document
