I am writing to request an internal review of Australian Broadcasting Corporation's handling of my FOI request 'Cost to produce content "Searching for trough man"'.

Referring to your decision relating to my FOI request No. 2017-014

Your letter states that your decision not to release contractual and invoice documents was made partly on the basis that you consider the documents be "relating to program material".

I would like to bring to your attention that my request specifically relates to the cost to produce the program material and not to the program material itself. Therefore I restate my request specifically for the part of these documents which relate the cost to produce the radio program and the graphical image of the man lying in a urinal. I concede that the parts of these documents which contain information "relating to program material" may be redacted in view of this FOI exemption.

Your letter also explains that your decision to refuse these documents was made considering that the documents contain personal information. Again, I will restate my request specifically to the part of these documents which relate the cost to produce the content and understanding that names and addresses would be redacted from these documents for security and privacy reasons.

Your letter states that your decision not to release these contractual and invoice documents was made considering that this would "risk commercial harm" to the third party business. I would contest this assertion carries relatively little weight in view of the one-off nature of the contract in question and the public interest in releasing the cost to taxpayers. In so far as the third party business was contracted by a taxpayer funded entity it can be reasonably expected that the business should be offering services at a competitive rate. If this is the case than the public disclosure of that rate will not cause any "commercial harm" to the third party. It is common practice in the case of tenders for other public contracts that, after the winning tender has been chosen, the losing tenderers will be notified of the winning bid. Often this information is made public in the interest of financial transparency and ensures fair competition. It is reasonable to expect that the ABC also contracts external work on a competitive basis rather than favour any particular business. Therefore, it can be assumed that the third party businesses rate should reflect the overall market rate for these services and therefore there is no commercial harm done to that business by revealing their rate to their competitors. To illustrate this point further it is noted that in other service based industries it is common to subcontract out work to other companies that may otherwise be considered competitors and in doing so rates are . While there may be commonly held perceptions that rates are commercially sensitive information it is actually not the case.

I acknowledge the importance of your comments relating to concerns about hate speech and anti-homosexual attacks. However these are not relevant to the specific request for the documented cost to produce this content. It is reasonable to assume that all personal information would be redacted from these documents without undue effort on the part of the ABC.

I would like request that the independent review of my request carefully consider that it is in the public interest to disclose the cost to taxpayers for the content provided to them. The cost information would inform public debate on the cost and benefit of ABC content. This is especially relevant in the modern context of rapid technology change which gives viewers and listeners an ever increasing number of free to air or paid services to choose from.

material itself. Therefore I restate my request specifically for the part
of these documents which relate the cost to produce the radio program and
the graphical image of the man lying in a urinal. I concede that the parts
of these documents which contain information "relating to program
material" may be redacted in view of this FOI exemption.

 

Your letter also explains that your decision to refuse these documents was
made considering that the documents contain personal information. Again, I
will restate my request specifically to the part of these documents which
relate the cost to produce the content and understanding that names and
addresses would be redacted from these documents for security and privacy
reasons.

 

Your letter states that your decision not to release these contractual and
invoice documents was made considering that this would "risk commercial
harm" to the third party business. I would contest this assertion carries
relatively little weight in view of the one-off nature of the contract in
question and the public interest in releasing the cost to taxpayers. In so
far as the third party business was contracted by a taxpayer funded entity
it can be reasonably expected that the business should be offering
services at a competitive rate. If this is the case than the public
disclosure of that rate will not cause any "commercial harm" to the third
party. It is common practice in the case of tenders for other public
contracts that, after the winning tender has been chosen, the losing
tenderers will be notified of the winning bid. Often this information is
made public in the interest of financial transparency and ensures fair
competition. It is reasonable to expect that the ABC also cont  racts
external work on a competitive basis rather than favour any particular
business. Therefore, it can be assumed that the third party businesses
rate should reflect the overall market rate for these services and
therefore there is no commercial harm done to that business by revealing
their rate to their competitors. To illustrate this point further it is
noted that in other service based industries it is common to subcontract
out work to other companies that may otherwise be considered competitors
and in doing so rates are . While there may be commonly held perceptions
that rates are commercially sensitive information it is actually not the
case.

 

I acknowledge the importance of your comments relating to concerns about
hate speech and anti-homosexual attacks. However these are not relevant to
the specific request for the documented cost to produce this content. It
is reasonable to assume that all personal information would be redacted
from these documents without undue effort on the part of the ABC.

 

I would like request that the independent review of my request carefully
consider that it is in the public interest to disclose the cost to
taxpayers for the content provided to them. The cost information would
inform public debate on the cost and benefit of ABC content. This is
especially relevant in the modern context of rapid technology change which
gives viewers and listeners  an ever increasing number of free to air or
paid services to choose from.
