This is an application to access documents held by the Attorney-Generals Department pursuant to s15 of the Freedom of Information Act 1982 (Cth).

Please provide copies of the following documents:

1. Data retention implementation plans approved under s187F of the Telecommunications (Interception and Access) Act 1979 (Cth) (“Act”).
2. Any correspondence with service providers as a result of a decision under s187F(1)(a)-(b) of the Act.
3. Any correspondence related to s187G(1)(b) of the Act.
4. Any correspondence to or from the service provider related to s187G(2)(c) of the Act.

Copies of the documents can be supplied via return email.

Dear Mr Galbraith,

Freedom of Information Request FOI 15/238

I refer to your request under the Freedom of Information Act 1982 (FOI
Act) for access to documents relating to data retention plans under the
Telecommunications (Interception and Access) Act 1979 (Cth). I have taken
your request to be for:

1. Data retention implementation plans approved under s187F of the
Telecommunications (Interception    and Access) Act 1979 (Cth) (“Act”).

2. Any correspondence with service providers as a result of a decision
under s187F(1)(a)-(b) of the Act.

3. Any correspondence related to s187G(1)(b) of the Act.

4. Any correspondence to or from the service provider related to
s187G(2)(c) of the Act.

 

If you disagree with this interpretation of your request, please let me
know as soon as possible.

We received your request on 5 December 2015 and the 30 day statutory
period for processing your request commenced from the day after that date.
You should therefore expect a decision from us by Tuesday 5 January 2015.
The period of 30 days may be extended if we need to consult third parties
or for other reasons. We will advise you if this happens.

It is the usual practice of the department to not disclose the names and
contact details of junior officers of the department and other government
agencies, where that personal information is contained in documents within
the scope of a request.  The names and contact details of senior officers
will generally be disclosed.  We will take it that you agree to the
removal of junior officers’ personal information unless you advise that
you would like us to consider releasing that information as part of the
documents you have requested.

Please note that information released under the FOI Act may later be
published online on our disclosure log

Extension of time to process request

I would like to request your consent to an extension of time to enable us
to complete processing your request.  Under section 15AA of the FOI, I am
empowered to seek your written agreement for an extension of up to 30
days.

The reason I am seeking this extension is because the department shuts
down for the holidays, from Christmas Day to 1 January (re-opening Monday
4 January). Therefore, the department loses more than a week of processing
time for this request.   

At present, the due date for completion of your request is 5 January
2015.  Should you be amenable to a 6 day extension your request would fall
due on Monday 11 January 2016.  Would you please advise us in writing
whether you agree to this extension.

However, given this department shuts down from 25 December and doesn’t
reopen until Monday 4 January 2016, we will respond to any correspondence
sent during that time, when we return on 4 January. If no correspondence
is received from you during that period (between today 17 December and 3
January 2016), your request will be taken to have been withdrawn.
