Documents relating to the selection of Susan O'Connor as an SES Band 1 National Judicial Registrar in the Federal Court

Dear Federal Court of Australia,

According to a document associated with disclosure 2925-06/9 published on the Federal Court of Australia's FOI disclosure log (www.fedcourt.gov.au/disclosurelog), Susan O'Connor was engaged, in November 2018, from outside of the Australian Public Service, to fill an SES Band 1 National Judicial Registrar role, based in New South Wales, on a full time, ongoing basis.

Given that Ms O'Connor was engaged from outside of the Australia Public Service as an SES Band 1 National Judicial Registrar, Ms O'Connor could not have been transferred into the Federal Court Statutory Agency under sections 26 or 27 of the Public Service Act 1999.

Given that Ms O'Connor was engaged from outside of the Australia Public Service as an SES Band 1 National Judicial Registrar, one would expect that Ms O'Connor applied for the SES Band 1 National Judicial Registrar role that she was selected to fill.

Given that Ms O'Connor was engaged from outside of the Australia Public Service as an SES Band 1 National Judicial Registrar, one would expect that the SES Band 1 National Judicial Registrar role was advertised to people outside of the Australian Public Service (i.e. to the Australian community).

All fairly uncontroversial.

Under the FOI Act I request access to:

a) the vacancy notification published in the Public Service Gazette for the SES Band 1 National Judicial Registrar role that Susan O'Connor was selected to fill;

b) the position description for the SES Band 1 National Judicial Registrar role that Susan O'Connor was selected to fill;

c) any and all classification evaluation documentation for the SES Band 1 National Judicial Registrar role that Susan O'Connor was selected to fill;

d) the record of the analysis leading to the task and job design of the SES Band 1 National Judicial Registrar role that Susan O'Connor was selected to fill;

e) the record of the supporting reasons for the classification decision, including reference to the comparisons made with formal standards (e.g. the Australian Public Service Commissioner's work level standards) for the SES Band 1 National Judicial Registrar role that Susan O'Connor was selected to fill;

f) the assessment of the resource impact of the creation of the SES Band 1 National Judicial Registrar role that Susan O'Connor was selected to fill;

g) the evidence that there was a need for the SES Band 1 National Judicial Registrar role that Susan O'Connor was selected to fill;

h) the job application Susan O'Connor submitted for the SES Band 1 National Judicial Registrar role that she was selected to fill;

i) the certification that the Australian Public Service Commissioner's representative issued following his or her participation in the selection process for the SES Band 1 National Judicial Registrar role that Susan O'Connor succeeded in securing;

j) any and all correspondence between staff in the Federal Court and the Australian Public Service Commissioner's representative in relation to the selection process for the SES Band 1 National Judicial Registrar role that Susan O'Connor succeeded in securing;

k) to the extent that the Australian Public Service Commissioner personally participated in the selection process for the SES Band 1 National Judicial Registrar role that Susan O'Connor secured, any correspondence sent to the Australian Public Service Commissioner or his staff by staff members in the Federal Court in relation to his participation in the selection process for that SES Band 1 National Judicial Registrar role;

l) the record of decision (by a selection panel or otherwise) to select Susan O'Connor to fill the SES Band 1 National Judicial Registrar role; and

m) the record of the reasons for decision (by a selection panel or otherwise) to select Susan O'Connor to fill the SES Band 1 National Judicial Registrar role.

Please read these paragraphs very carefully. For example, consider paragraph (h). I do not want to be provided with any job application that Susan O'Connor submitted for any other roles in the Federal Court.

As you will now probably appreciate, I know a bit more about the rot in the Federal Court than the average access applicant. Tread cautiously.

In relation to my FOI request, I note that paragraph (m) should read:

m) the record of the reasons for decision (by a selection panel or otherwise) to select Susan O'Connor to fill the SES Band 1 National Judicial Registrar role following a merit based selection process for the SES Band 1 National Judicial Registrar role.

You will notice that the request for the record of decision, and the request for the record of reasons for decision, are qualified by the selection of Susan O'Connor to fill the SES Band 1 National Judicial Registrar role FOLLOWING A MERIT BASED SELECTION PROCESS FOR THE SES BAND 1 NATIONAL JUDICIAL REGISTRAR ROLE. The meaning of merit based selection is set out, inter alia, in the Public Service Act 1999 and the Australian Public Service Commissioner's Directions.
