has received your Freedom of Information request of 19 December 2020

We refer to your FOI request of 19 December 2020 to the Department of
Industry, Science, Energy and Resources (the department).  

 

Notice of Consultation

 

Your request covers documents that contain information about the business
affairs of certain organisations.

 

Under section 27 of the FOI Act where a request is made for a document
containing information about the business affairs of an organisation and
it appears the organisation may reasonably wish to contend that the
information is exempt or conditionally exempt, the department must give
the organisation a reasonable opportunity to make a submission in support
of the contention.

 

The department must have regard to any submissions made by the
organisation before making a decision to give access to the document.

 

Given that consultation with a third party is required, the statutory
timeframe for processing your FOI request is extended by 30 days under
subsection 15(6) of the FOI Act.

 

Currently, a decision is due to you on or before Wednesday 17 February
2021.

Extension of time application by the Department of Industry, Science,
Energy and Resources  

Dear Mr Phu

 

I write to advise that on 16 February 2021 the Office of the Australian
Information Commissioner (the OAIC) received an application from the
Department of Industry, Science, Energy and Resources (the Department) for
an extension of time, to process your FOI request.

 

The Department has applied for an extension of time under s 15AB of the
Freedom of Information Act 1982 (Cth) because your request is considered
to be complex.

 

The Department has advised the OAIC that:

 

·       document searches and retrieval have been completed

·       the Department advise that the statutory timeframe had already
been extended to allow for consultation in accordance with s 15(6) of the
FOI Act and is currently awaiting a third party consultation response

·       the Department considers your request to be complex due to the
large volume of requests received since June 2020 about similar subject
matter which has resulted in the Department devoting a significant amount
of resourcing to processing these requests

·       this includes additional time in conducting document searches,
document retrieval, engaging in consultations, commencing document review
and as a result has led to unavoidable delays in processing your request

·       additional external assistance has been sought by the Department
to process these requests and advise your request is in the advanced
stages of processing, and

·       additional time will enable the Department to follow up on the
third party consultation response and finalise the decision.

 

The Department has requested an extension to 3 March 2021. I will take any
comments you may have to make into account when deciding the application.

 

Please respond to this email by close of business 18 February 2021. If I
do not hear from you by this date, the decision maker will make a decision
on the basis of the information provided to me by the Department.

 

You will be notified of the decision once the matter has been finalised.

Dear Department of Industry, Science, Energy & Resources,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department of Industry, Science, Energy & Resources's handling of my FOI request 'Email correspondence regarding ISI application S5DN3C9P'.

I note that 5 documents were refused in full as it is alleged that they are about "Regional Incubator Facilitators and other third party individuals" and that they include "identifying information, contact details, employment history, photographs and other information of a personal nature".

I find it hard to believe that all these documents, in their entirety, amount to personal information about the authoring officer. Unless the correspondence is essentially an auto-biagraphy, please redact the personal information and release the surrounding content as per request.
