Employee information provided to ballot agents in Enterprise Agreement bargaining

James Smith made this Freedom of Information request to Australian Fisheries Management Authority as part of a batch sent to 42 authorities

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was successful.

Dear Australian Fisheries Management Authority,

This is a request for information under the Freedom of Information Act.

I request the document(s) which describe the data provided to the external organisation(s) responsible for conducting the ballot(s) for all Enterprise Agreements put to staff for a vote.

The scope of this request is limited only to those ballots undertaken for enterprise agreements which were proposed to take effect after 30 June 2014.

The document shall describe the data given to the ballot agent. For example, employee name, employee identification number, employee email address, etc. I exclude the data for specific employees here; I am only after the 'meta-data'.

If it assists you to treat this as an administrative request for information I encourage you to do so. Otherwise, please consider this a formal FOI request.

Yours faithfully,

James Smith

Dear Mr Smith,

Urgent and Important

By Email Only

I refer to your email below requesting information pursuant to the FOI Act
, or administratively.

Wherever possible it is preferable to treat an application
administratively and I have decided to proceed on that basis having had a
brief discussion with the executive - it assists both agencies and
applicants in my view.

Given we are proceeding administratively and can be far less formal than
the process pursuant to the FOI Act I was wondering if you could clarify,
go into more detail, as to exactly what data you would like to obtain.

Your request below is described as “metadata” yet you say you wish to
exclude employees details etc ? Metadata, as I understand it, is the
detailed data underlying or contained in properties of data itself. For
example, a digital photograph would be “data”; the date, time, file size,
file format, etc I would interpret as the Metadata.

Please feel free to respond in general terms to discuss or,  clarify your
request if you understand what I am expressing.

Warm Regards

Mark

Dear Mr LINDSEY-TEMPLE

Thank you for your email.

I would like to know what information about your employees was passed onto the organisation who conducted your enterprise agreement ballots.

Please refer to the following response provided by the Education department as an example of what I am looking for:

https://www.righttoknow.org.au/request/3...

You can see it is a list of the data fields provided to the ballot provider - not the actual data that would identify each of your employees.

As I have already waited a month before you sought to clarify my request, I kindly ask you provide the requested information as soon as possible.

Yours sincerely,

James Smith
