Regina Rutten, Australian Charities and Not-for-profits Commission

Good afternoon Mr Smith,

I refer to your email below in which you request access to information
under the Freedom of Information Act 1982 (Cth) (the FOI Act).

I am the Australian Charities and Not-for-Profits Commission (ACNC) FOI
Contact Officer and your request for documents has been forwarded to me to
action.

Please note that ACNC staff are employed by the Australian Taxation Office
(ATO) and made available to the ACNC by the Commissioner of Taxation (s
120-5 of the Australian Charities and Not-for-profits Commission Act 2012
(Cth)). Accordingly, the information you seek, if it exists, would be held
by the ATO and not the ACNC.

While I would ordinarily approach the ATO to ask if they would accept a
transfer of your request pursuant to s 16 of the FOI Act, I note from the
Right to Know website that you have already sent a request for these
documents to them. As such, I ask that you withdraw your request to the
ACNC.

Could you please advise, by return email, whether you agree to withdraw
your request?

Please do not hesitate to contact me should you have any queries.

Regards,

Regina Rutten
