Acknowledgement of Freedom of Information Access request

I refer to your correspondence below seeking access to documents held by
the Department of Home Affairs (the Department) under the Freedom of
Information Act 1982 (the FOI Act).

Your request has been allocated the FOI reference number referred to

The information you have requested is available through a Qlik application
which can be accessed via the Department’s SkillSelect [1]web page and

persons wishing to reference EOI data. I consider that the information you

Dear Adnan Zafar

 

I refer to your email received by the Department of Home Affairs (the
Department) on 12 May 2020, in which you requested an internal review in
relation to your Freedom of Information request FA 20/04/00646.

 

Your request for access to documents

Your request for access to documents was received by the Department on 11
April 2020. On 14 April 2020, the Department acknowledged your request and
advised that the information to which you sought access was available
through the Department’s SkillSelect web page.

 

The Department also requested you contact the Department within five
working days (that is – by Tuesday 21 April 2020) to advise whether you
wished to continue with your FOI request.

 

The Department did not receive a response from you to its email of 14
April 2020. Accordingly, on 23 April 2020, the Department deemed your
request to have been withdrawn and closed it.

 

Whether internal review request valid

The right for an applicant to seek internal review is specified in Part VI
of the FOI Act, which provides that an applicant may request an internal
review of an ‘access refusal decision’ made by an agency. The types of
decisions that are reviewable access refusal decisions are [1]specified in
section 53A of the FOI Act.

 

As the Department deemed your request to have been withdrawn, and
finalised it before making an access decision, I consider that the
Department has not made a decision that meets the requirements of a
reviewable access refusal decision as defined in section 53A of the FOI
Act.

 

Consequently the Department has determined that your internal review
request is invalid and will be taking no further action on it.

 

Next steps

Should you still wish to seek access to the information requested, you may
wish to lodge a new FOI request. Should you make a new request and the
Department again seek your advice on proceeding with the request, if you
advise that you wish to proceed with the request, the Department will then
make a decision on the request for which you will have the right to seek
internal or external review.

 

Making a complaint to the Office of the Australian Information
Commissioner

You may complain to the Australian Information Commissioner about action
taken by the Department in relation to your request.
