Ben Fairless made this Freedom of Information request to Australian Commission for Law Enforcement Integrity

The request was refused by Australian Commission for Law Enforcement Integrity.

From: Ben Fairless

Delivered

Dear Australian Commission for Law Enforcement Integrity,

Under section 23 of the Freedom of Information Act, the principal officer or minister can make arrangements to give their decision making powers to others.

I'm hoping you can provide me with a copy of the current arrangements if possible.

If it helps, I'm happy for you to process this request under "administrative release" (https://www.oaic.gov.au/freedom-of-infor.... This would reduce the cost and time required to make a formal decision.

That said, I understand sometimes you want the request to be formal. If you won't process it informally, please process my request for the document as a formal FOI Request.

Please note - While I volunteer for Right to Know, this request is made in a personal capacity and not on behalf of Right to Know.

Yours faithfully,

Ben Fairless

Hi Ben,

It would assist greatly if we could speak about this request so I can work out exactly what documents you are seeking. I can only identify one document held by ACLEI which falls in the scope of your request, which, as it contains a list of staff members' names, would be heavily redacted if we were to provide it to you.

I am happy to discuss if this is what you are looking for, or if you had a different idea of what you are requesting, in which case you can resubmit your request. Please could you contact me this afternoon at a convenient time on 0436 670 259, so we can assist you in a timely manner.

I look forward to discussing the details a bit further.

Many thanks,

Claire

Dear ACLEI FOI,

Thanks for providing the document under administrative release.

As you have redacted the names of the officers, please consider this a formal request for the document including the names of the officers under the Freedom of Information Act. I do not consent to any s.22 redactions.

The FOI Guidelines relevantly state:
6.153 Where public servants’ personal information is included in a document because of their usual duties or responsibilities, it would not be unreasonable to disclose unless special circumstances existed. This is because the information would reveal only that the public servant was performing their public duties. Such information may often also be publicly available, such as on an agency website.

Yours sincerely,

Ben Fairless
