Dear Mr Johnson

 

Thank you for your email dated 6 February 2020, received by the Department
of the Prime Minister and Cabinet (the Department), in which you made a
request under the Freedom of Information Act 1982 (the FOI Act) in the
following terms:

 

I would like to request a copy of the recent Gaetjens report as well as
all related internal emails, meeting minutes and comms related to it since
inception of the McKenzie enquire.

 

The Department requires clarification from you regarding your request to
enable the Department to conduct reasonable searches and identify the
documents that you are seeking to access, if they exist.

 

Could you please provide the following further information to enable the
Department to undertake searches of its relevant systems:

·         In relation to ‘related internal emails, meeting minutes and
comms’ in your request, could you please specify whether this relates to
documents that informed the development of the Report, or documents that
were produced or received after the Secretaries report was provided to the
Prime Minister, or both.

·         In relation to your reference to ‘comms’ in your request, could
you please specify whether you are seeking media commentary or whether
media commentary can be excluded from the scope of your request.

 

Please note that the statutory time frame for processing your request will
commence once the scope has been sufficiently clarified to enable the
Department to identify the documents you are seeking, if they exist.

Thank you for your email of 7 March 2020. We confirm that following your
clarification of 18 February 2020 (which was in response to our email of
17 February 2020 requesting clarification of your request), the Department
considered that your request was valid from that date of clarification,
and accordingly the Department has taken your request to be in the
following terms:

 

I would like to request a copy of the recent Gaetjens report as well as
all documents that both informed and were informed by the report.

 

Media reports are excluded.

 

Timeframe for receiving your decision

 

As indicated above, the Department received your valid request on 18
February 2020 and the 30 day statutory period for processing your request
commenced from the day after that date. You should therefore expect a
decision from us by 19 March 2020. The period of 30 days may be extended
in certain circumstances. We will advise you if there is any extension of
time.

 

Charges

 

Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the Department decides that you
are liable to pay a charge, we will send you a preliminary assessment of
the charge as soon as possible.

 

Publication of documents

 

Please note that information released under the FOI Act may later be
published online on our disclosure log at

subject to certain exceptions. If you think you might wish to raise any
objections to the publication of any of the information which may be

For documents that fall within scope of the request, it is the
Department’s policy to withhold:

·         any person’s signature;

·         the names and contact details of Australian Public Service
officers not in the Senior Executive Service (SES);

·         the mobile or direct numbers of SES officers;

·         the names and contact details of Ministerial staff at a level
below Chief of Staff.

 

The names and other details of SES officers will not be withheld unless
there is some reason for that information to be exempt from release. If
you require signatures, the names and contact details of non-SES officers
or Ministerial staff below the level of Chief of Staff, or the mobile or

the decision-maker may consider; otherwise we will take it that you agree
to that information being excluded from the scope of your request (that

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department of the Prime Minister and Cabinet's handling of my FOI request 'Gaetjens report and all related internal DPMC emails about it since inception of McKenzie enquiry’.

I realise the documents are labelled as cabinet in confidence, but the Australian public deserves to know given the grants are funded by taxpayer money. There is significant interest in the topic and it is simply not fair that the Prime Minister can hide corrupt behaviour behind obscure paragraphs.
