Freedom of Information request

I refer to your request for access to documents made under the Freedom of
Information Act 1982 (Cth) (the FOI Act) and received by the Office of the
Australian Information Commissioner (OAIC) on 25 October 2018.

Scope of your request

In your email you seek access to the following:

                I seek copy under FOI of the OAIC policy regarding gifts
and copy of the FY17/18 Gift Register.

 

Timeframes for dealing with your request

Section 15 of the FOI Act requires this office to process your request no
later than 30 days after the day we receive it. However, section 15(6) of
the FOI Act allows us a further 30 days in situations where we need to
consult with third parties about certain information, such as business
documents or documents affecting their personal privacy.

As we received your request on 25 October 2018, we must process your
request by Monday, 26 November 2018.

Disclosure Log

Documents released under the FOI Act may be published online on our
disclosure log, unless they contain personal or business information that
would be unreasonable to publish.

Dear Megan McKenna,

I had a question about the corporate hospitality several senior OAIC staff accepted from large consultancy firm elevenM, who works for major organisations like the Commonwealth Bank (that the OAIC recently declined to undertake further action against when they ‘lost’ a backup tape containing the sensitive financial data of hundreds of thousands of Australians).

While I note that former OAIC staff members are now senior executives with elevenM, was there any documented consideration of these offers accepted, given the ethics involved in accepting gifts from a third party entity that (while admittedly having close links to the OAIC) is directly working in the privacy field for the benefit of major organisations and represent their interests.

If there is such documented consideration, in line with your gift policy, would the OAIC release it? It would be useful to understand how the OAIC manages such conflicts of interest, especially when it involves external organisations that are lead by former OAIC staff.

With reference to your query, I have completed a search of the OAIC’s
records and it does not appear that documents exist that documented
consideration of the acceptance of the gift from elevenM.

 

I hope this response satisfies your enquiry, however if I can be of any

I acknowledge your response that no records of any consideration of the probity of several senior OAIC accepting corporate hospitality from elevenM, exist.
