Dear Australian Federal Police,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Australian Federal Police's handling of my FOI request 'List of businesses compromised in $30m Romanian credit card fraud'.
In response to the Australian Federal Police’s refusal of my Freedom of Information request I would like to take issue with each of the points raised.
* Subsection 33(b)
I am only interested in the list of Australian businesses compromised in the credit card fraud. I find it difficult to believe that the release of a list _Australian_ businesses supplied by a _foreign_ government would “harm the future supply of information to the AFP”.
If indeed it is true that the information was supplied on a request of confidentiality, why was that done? Secondly did the AFP seek permission from the foreign government for this list of Australian businesses to be released?
* Subsection 37(1)(a)
I have requested a list of Australian businesses known to have been compromised. In the AFP media release 29 November 2012 http://www.afp.gov.au/media-centre/news/...
“The operation came to resolution yesterday in Romania when 16 people were detained across Romania, seven of which were arrested and as a result, the criminal syndicate was successfully shut down. The AFP worked closely with Romanian authorities throughout the resolution and will continue to provide support during the prosecution phase in Romania.”
The media release states that the operation is now in its “prosecution” phase in Romania and is therefore not on ongoing investigation.
* Subsection 37(2)(a)
Firstly, the people in question are not being prosecuted in Australia. Secondly, it is difficult to see how releasing the list of compromised Australian businesses would prejudice the fair trial of the individuals. It would be like saying “We can’t say that this shop had its window smashed because that would prejudice the trial of the person accused of smashing it”. The fact that the shop had its window smashed is a fact and not disputable.
* Subsection 47e(d)
Again, it is difficult to understand how the release of a list Australian businesses would “have a substantial adverse effect on the proper and efficient conduct of the operations of the agency”. This appears spurious.
* The public interest
According to media reports and the AFP media release personal information of 500,000 (presumably mostly Australian) individuals was stolen. There is an overwhelming public interest in the public knowing the Australian businesses who were supposed to be safeguarding that personal information.
The public has a right to make their own informed decision whether they should do business with those Australian businesses again.
Without the release of this information they are not able to make an informed decision.
