Dear Department of Human Services,
National Welfare Fund 01/01/1946 was established by the Prime Minister Chiefly by charging all Taxpayer 7.5% levy. Like to know what happened to the fund and all the money accumulated belonging to the Australian Pensioners.

Lately I have found-out about this National Welfare Fund and our group of pensioners would like to know if is any thru in that and what happened to the found and the money. Is it in our rights to ask? what is that we should not know? and why not? after all is our money, and I have startin working since 1961, so I got the right to know.

I understand that you would like further information about the National
Welfare Fund. However, as stated in my letter dated 22 September 2015, the
right of access under the FOI Act is a right to access documents, rather
than a right to access to information.
If you wish to continue with your current request to this department you
will need to consider the issues I have raised in paragraphs 6—12 of my
letter when revising the scope of your FOI request to ensure that it is a
valid request. I note that the consultation period ends at midnight 6
October 2015.
Please note, it is unlikely that the department holds the type of
information you are seeking access to. I suggest that you withdraw your
current FOI request with the department and submit a fresh request to the
Department of Finance and/or The Treasury as the information you are
seeking is more closely aligned with the functions and responsibilities of
the Department of Finance and/or The Treasury.

You are exactly correct. There are two different types of "freedom of ... " legislation. The older type of legislation gives people a right of access to documents that already exist, not to information that a person would have to collect together to make a document. The newer type of legislation gives people a right of access to information. With this type, it is OK to ask for something that is not already in a document and where a person from the agency must create a new document with the information.
The Freedom of Information Act 1982 of the Commonwealth of Australia is the older type of legislation. Do not be misled by the words "freedom of information"; it could be more correct if the parliament had called it "Right of Access to Documents Act"! Many of the states of Australia have similar legislation; they have the words "freedom of information" in the name for the legislation but really it is "access to documents". The states of New South Wales and Tasmania have the new legislation that gives people a right to access information. For this reason, on the websites of many authorities in New South Wales you can find a link that says "Right to Information". In the places with the older legislation, almost every time this kind of link says "FOI".
When you ask a question or you as for information from an "FOI" place (older legislation) almost every time the FOI officer will ask you, "what document do you want"!

In my experience I have learned that the Request should not be a question but a specific name of a document you would like to request.
