Recovery of funds from participants

Response to this request is long overdue. By law, under all circumstances, National Disability Insurance Agency should have responded by now (details). You can complain by requesting an internal review.

Dear National Disability Insurance Agency,

I request the following information:
- The titles and delivery dates of all final reports and documents delivered to or produced within the Directorate, since 1 January 2010, in relation to compensation recovery
- The titles and delivery dates of all final reports delivered to or produced by the Directorate, since 1 January 2010, in relation to the recovery of funding from participants.

To be clear, I am not requesting the title page, I am instead am instead requesting the title/names of reports. This should be no more than a few words for each relevant document.

Please exclude duplicates from this FOI request.

Given the significant public and recent media interest in this matter, I request that the usually applicable FOI fees be waived in this instance.

Yours faithfully,

John Smith

Dear John Smith

Thank you for your request for information.

We are writing to help you to narrow the scope of your request, because at
this stage it appears to be unclear.

Scope of your request

You have requested access to:

“- The titles and delivery dates of all final reports and documents
delivered to or produced within the Directorate, since 1 January 2010, in
relation to compensation recovery

- The titles and delivery dates of all final reports delivered to or
produced by the Directorate, since 1 January 2010, in relation to the
recovery of funding from participants.
To be clear, I am not requesting the title page, I am instead am instead
[sic] requesting the title/names of reports. This should be no more than a
few words for each relevant document…”

We are seeking your help to narrow the scope of your request so that we
can provide the information you are seeking more quickly.

With regard to the request ‘for all documents delivered to or produced
within the directorate ‘ since 2010, this would benefit from further
clarification. If taken at literal meaning this would be potentially many
tens or hundreds of thousands of documents, many of which relate to
individual participants and which we would not be inclined to disclose for
privacy reasons.

In order for your request to meet the requirements of the FOI Act, it must
provide enough information about the documents you are seeking to enable
us to locate them.

Could you please be more specific of the meaning of ‘Directorate’. You are
requesting reports created from the start date of 2010, however the NDIS
commenced operation in the year of 2013.
Could you also please provide more specific search terms for requested
reports in relation to ‘compensation recovery’ and ‘recovery of funding
from participants’. The word ‘reports’ is quite a broad category and could
be interpreted in a number of ways.

Next steps

Please let me know by 19 September 2022.

Please contact us at [1][NDIA request email] if you have any questions or
require help.

Kind regards

Dear foi team

Apologies, by Directorate I meant agency, and from 2013 would be appropriate - thank you.

Yours sincerely,

Dear John Smith

Thank you for your correspondence of 14 September 2022, where you state
”…by Directorate I meant agency, and from 2013 would be appropriate…”.

However, further clarification is still sought to the actual documents you
are requesting. For your request to meet the requirements of the FOI Act,
it must provide enough information about the documents you are seeking to
enable us to locate them.

Could you kindly please provide more specific search terms for the actual
requested reports in relation to ‘compensation recovery’ and ‘recovery of
funding from participants’. There are potentially many tens or hundreds of
thousands of documents, many of which relate to individual participants
and which we would not be inclined to disclose for privacy reasons.

Next steps

Please let me know by 19 September 2022.
