I request the following documents under the FOI Act -

1. In relation to the SES1 National Judicial Registrar role that Susan O’Connor was engaged to fill, the recruitment packages made available to the public containing, for example, role specifications, statements about the duties to be undertaken in the SES1 National Judicial Registrar role, and statements about the SES1 National Judicial Registrar role in the light of relevant APS work level standards.

2. In relation to the “Legal 2” National Judicial Registrar roles that Phillip Allaway, Matthew Benter, Rupert Burns, Claire Gitsham, David Ryan and Tuan Van Le appear to have been engaged or promoted to fill, the recruitment packages made available to the public containing, for example, role specifications, statements about the duties to be undertaken in the “Legal 2” National Judicial Registrar role, and statements about the “Legal 2” National Judicial Registrar role in the light of relevant APS work level standards.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Federal Court of Australia's handling of my FOI request 'Recruitment packages made available to the Australian community for the Federal Court's National Judicial Registrar positions'.

The documents that you say respond to the terms of my FOI request do not in fact do that.

In your decision letter you state that:

"Extensive searches were undertaken by staff of the Court to identify any documents falling
within the scope of your request. These searches included consultations with senior staff in the
Court’s People and Culture team , searches of the Court’s human resources and recruitment
inboxes, searches of staff emails, searches of the human resources shared drive, and searches
of the Court’s electronic document, records management and information systems. I am not
aware of any other steps that could reasonably have been taken to identify the documents you
have requested.

As a result of the searches undertaken, three (3) documents were identified as falling within
the scope of your request, as follows:

• Gazette Notice – Judicial Registrar;
• Position Description – Judicial Registrar; and
• SEEK Advertisement."

It is clearly the case that I did not ask you for any "Judicial Registrar" documents. I asked you for documents relating to the SES Band 1 and EL2 "National Judicial Registrar" roles.

If you would take a moment to check the Federal Court's disclosure log, you will notice that there is a position description for the SES1 National Judicial Registrar published on the disclosure log - document associated with PA2925-06/8, pages 35-40. I question your claims about "extensive searches" being undertaken.

I requested the following documents under the FOI Act:

1. In relation to the SES1 National Judicial Registrar role that Susan O’Connor was engaged to fill, the recruitment packages made available to the public containing, for example, role specifications, statements about the duties to be undertaken in the SES1 National Judicial Registrar role, and statements about the SES1 National Judicial Registrar role in the light of relevant APS work level standards.

2. For example, I know that Susan O'Connor was selected for the SES1 National Judicial Registrar role, that she commenced working in that role in November 2018, that she was engaged from outside the Australian Public Service, that she was engaged as an ongoing, full-time employee, and that she is based in New South Wales (https://fedcourt.gov.au/disclosurelog - PA2925-06/9, document associated with "Request 2" document). She obviously applied for the SES1 National Judicial Registrar role from outside the Australian Public Service, which would have been published somewhere for members of the Australian community to apply for that role. I would like a copy of the recruitment package (e.g. vacancy notice, classification evaluation. position description etc). I would like statements about the SES1 National Judicial Registrar role in the light of relevant APS work level standards. Please provide them.

Not one of the documents you have provided addresses my FOI request.

Your decision was very careless and you have plainly made claims about "extensive searches" that cannot be taken seriously.
