Dear Queensland Department of Justice and Attorney-General,

It is requested that you provide a copy of the original Australia Acts Request Act 1985 containing the Royal Coat of Arms used to Seal the document i.e. you provide a copy of the front and rear page of the certified copy, your office relied on for its valid creation.

I would also like to establish the current status of the Act, if the above Act has been Repealed, or is it "No Longer in force"?

For what reasons was it either repealed or the Act No Longer in Force, which ever might apply?

Dear Queensland Department of Justice and Attorney-General,

Your office has not complied to our RTI request which was a Request for a copy of the Australia Acts Request Act 1985 QLD containing the Royal Coat of Arms used to Seal the document. You have not provided this us with the requested document promptly, as normally required by law. Your office is required to provide the document, not me having to request a copy of the document from any other department of the QLD State Government.
I only seek this document if it is constitutionally compliant with the Commonwealth of Australia Constitution Act 1900, specifically that it complies with the head of power in Covering Clause 2, and not those as generally accepted. Can you be so kind to acknowledge receipt of this request.

The Australia Acts Request Act 1985 was repealed on 6 June 2002. Repealed
legislation can be located on the Queensland Government legislation

To obtain a copy of the sealed Bill assented to by the Governor, please
contact the Table Office at Parliament House
[2][email address].

 

When the Governor Assent to Bills, the Clerk takes two sealed originals.
One original is retained at Parliament and the other copy is deposited in
the Registry of Titles. See Chapter 28 of the Standing Rules and Orders
for further info:

We understand the Table Office will provide members of the public with
photocopies of sealed Bills if requested.

It is my understanding, that your office at law, must provide the documents I requested. Please direct me to the specific section of the relevant legislation that might prove your Office is not obligated to source and provide a copy of these documents requested?

Your office is responsible for administering justice in Queensland, and must minimise duplication of services of which sending me to another department to physically obtain the document myself, does not enhance service delivery to the community.

When will you be able to provide me with a copy these documents as requested and as required at law?

I refer to your email to Right to Information and Privacy, Department of

requesting that we direct you to the specific section of the relevant
piece of legislation that might prove that our office is not obligated to
source and provide a copy of the document you have requested.

 

Section 12 of the Right to Information Act 2009 states -

 

              S.12       Meaning of document of an agency

                             In this Act, document, of an agency, means a
document, other than a document to which this Act does not apply, in the
possession, or under the control, of the agency whether brought into
existence or received in the agency, and includes-

(a)    a document to which the agency is entitled to access;  and

(b)    a document in the possession, or under the control, of an officer
of the agency in the officer’s official capacity.

 

The document you are seeking is not in the possession, or under the
control, of the Department of Justice and Attorney-General and therefore
we are unable to provide you with same.
