commencement, and/or any announcement of date for "detailed design and field inspection work" for work related in THORNLANDS (NON-GREENFIELD) estates.

Or any information regarding rollout in THORNLANDS QLD 4164.

To Whom It May Concern,

This is not good enough.

"The response to your request has been delayed. You can say that, by law, the authority should normally have responded promptly and by December 09, 2014"

I also like amend my original FOI request, I would like to know further costs associated the suburb of THORNLANDS, and any related documents to the rollout costs of the rollout generally in the Redlands.

Especially moving to FTTP.

Also it is December 10th.

Thank you for your email.

 

For your reference,  on 12 November 2014, I wrote to you explaining that
an aspect of your original FOI request was too broad (see attached). In
particular, you sought access to, "...any information regarding rollout in
THORNLANDS QLD 4164.” I explained that due to the breadth of this request,
this aspect of your request would result in an unreasonable diversion of
NBN Co’s resources to process. As a result, I asked you to review the
scope of your FOI request and to notify me by 26 November 2014 about
whether you wished to:

 

·         Withdraw your request;

·         Make a revised request; or

·         Not revise the request.

 

I explained that if you did not do any of the things set out above by 26
November 2014, your request would be deemed to have been withdrawn (see
the first paragraph on page 2). As you did not contact us by 26 November
2014, your request was deemed to have been withdrawn.

 

Based on your email below, it seems like you are seeking to re-define the
scope of your request to cover “further costs associated the suburb of
THORNLANDS, and any related documents to the rollout costs of the rollout
generally in the Redlands.” As your original request has been deemed to
have been withdrawn, you might want to lodge a new FOI request in order to
request this information instead. However, before we would be able to
acknowledge such a request, we would need to understand whether this
amended request would be intended to replace the original request or add
to it.

 

Also, I would also flag to you at this stage that a request for “any
related documents to the rollout costs of the rollout generally in the
Redlands” is very broad and could include a very wide range of documents
and emails, including drafts of those documents. As a result, processing
this request could amount to an unreasonable diversion of NBN Co
resources. If so, we would be required to undertake a request consultation
process with you which might result in us refusing access to your request.

 

In addition to the issue raised immediately above, there is a strong
possibility that many of the documents within the scope of your re-defined
request would relate to NBN Co’s commercial activities and would not be
subject to the operation of the FOI Act. More information about NBN Co’s

Please let me know If you would like to lodge a new FOI request. If so, I
would suggest that you consider my comments above about the potential
breadth of your request and the likelihood that what you are seeking may
not be subject to the operation of the FOI Act. Submitting a more targeted
FOI request would help us in responding to your request. Please let me
know if you would like to discuss ways in which you could limit the scope
of your request. For example, it might be helpful for you to limit the
scope of your request to cover a certain period of time, to exclude
certain documents – i.e drafts, and to generally be more specific in the
nature of documents that you are requesting.
