Selection reports - National Judicial Registrar & District Registrar

I refer to vacancy notification NN 10725159 on pages 34-36 in Public Service Gazette No PS19 published on 10 May 2018.

The vacancy notification is for three National Judicial Registrar & District Registrar positions in the Federal Court (in Victoria, Queensland and Western Australia).

It appears as though a redacted version of the selection report for the National Judicial Registrar & District Registrar position in Victoria has been granted access to on the Federal Court’s disclosure log: see PA2925/06-13.

Under the FOI Act, I would like access to any selection reports for the Queensland National Judicial Registrar & District Registrar and Western Australia National Judicial Registrar & District Registrar positions provided to the Australian Public Service Commission by staff in the Federal Court of Australia.

There is a public interest in being provided with these selection reports because selection processes for registrars of the Federal Court have come under public scrutiny in the media and were the subject of investigation by the Australian Public Service Commission.

I am writing to request an internal review of Australian Public Service Commission's handling of my FOI request 'Selection reports - National Judicial Registrar & District Registrar'.

It is well known that the person who secured the role of National Judicial Registrar & District Registrar – QLD was Murray Belcher. That information may be gleaned from several public sources including the Federal Court of Australia’s Annual Reports for 2018-2019 (p 129) and 2019-2020 (p 125).

It is well known that the person who secured the role of National Judicial Registrar & District Registrar – WA was Russell Trott. That information may be gleaned from several public sources including the Federal Court of Australia’s Annual Reports for 2018-2019 (p 129), 2019-2020 (p 125) and 2020-2021 (p 126).

Please remove the redactions on the selection report for the SES Band 1 National Judicial Registrar & District Registrar – QLD position identifying Mr Belcher as the successful candidate for the role.

Please remove the redactions on the selection report for the SES Band 1 National Judicial Registrar & District Registrar – WA position identifying Mr Trott as the successful candidate for the role.

You may leave the redactions over the names of other candidates.

Also, it is well known that Mr Belcher and Mr Trott had been deputy district registrars in the Federal Court for many years prior to their promotions. Despite being promoted to SES Band 1 positions, I have not been able to locate promotion notices in the Public Service Gazette noting their promotions (unlike Mr Tim Luxton, who was promoted to the SES Band 1 National Judicial Registrar & District Registrar – VIC position, and whose promotion was noted in the Public Service Gazette: NN 10736921 in Gazette No PS 43 – 25 October 2018, p 36). I smell a rat.

Given Justice Greenwood’s criticisms of Ms Lagos, Mr Soden and the Australian Public Service Commission in an article published in the Australian on 10 February 2022, it is obvious that there is something very fishy going on. There is a public interest in exposing what appears to be corruption in relation to employment selection processes in the Federal Court of Australia.
