Request under the Freedom of Information Act 1982
Briefing notes for testimony by Secretary Halton to Senate Estimates
------------------------------------------------------------------

I request a copy of the briefing documents prepared for Secretary Halton to inform her testimony on 20 November 2014 to the Senate Finance and Public Administration Legislation Committee.

I request only documents that refer, directly or indirectly to the Open Government Partnership (OGP) and of such documents, only those parts of the documents that relate directly or indirectly to the OGP, including the possibility of Australia joining the OGP. This request is intended to encompass documents that were prepared for the stated purpose whether or not they were relied on or actually used by Secretary Halton in her testimony.

Dear Mr Diamond,

 

Freedom of Information Request – FOI14/166

Thank you for your email to the Department of Finance (Finance) 
requesting access to the following under the Freedom of Information Act
1982 (FOI Act).

 

I request a copy of the briefing documents prepared for Secretary Halton
to inform her testimony on 20 November 2014 to the Senate Finance and
Public Administration Legislation Committee.

 

I request only documents that refer, directly or indirectly to the Open
Government Partnership (OGP) and of such documents, only those parts of
the documents that relate directly or indirectly to the OGP, including the
possibility of Australia joining the OGP. This request is intended to
encompass documents that were prepared for the stated purpose whether or
not they were relied on or actually used by Secretary Halton in her
testimony.

 

The statutory period for processing your request commences from the day
after Finance received your request.  Your request was received by Finance
on 17 December 2014.  The processing period may be extended if we need to
consult third parties, impose a charge or for other reasons.  We will
advise you if this happens.

 

Liability to pay a charge

You will be notified of any charges in relation to your request as soon as
possible, before we process any requested documents or impose a final
charge.

 

Publication

As required by the FOI Act, any documents provided to you under the FOI
Act will be published on our [1]disclosure log, unless an exemption
applies or the documents are characterised as containing personal
information.  Documents will be published within one working day after
they are released to you.

 

Policy to exclude junior departmental officer contact details

Finance has adopted a policy to generally exclude the names and contact
details of junior staff (non-SES officers) from any documents released
under FOI. Finance’s preference is to reach agreement with FOI applicants
to exclude these details from the scope of the request. Where there is no
objection, the names and contact details of junior officers are redacted
under section 22 of the FOI Act, on the basis that these details are
irrelevant to the request.

Re my Request for briefing notes for testimony by Secretary Halton to Senate Estimates
------------------------------------------------------------------

I refer to the recent letter to me from Ms Sharyn Clarkson giving her decision to give me access to a document relevant to my request. My reason for writing is both the thank you for the document but also to request clarification about something that is not stated in the letter.

Implicit in the statement by Ms Clarkson that she has decided to release a document, and implicit in the list of documents in Attachment A of her letter, is the notion that the released document was the only document that was identified as being relevant to my request. Please could you confirm that that was indeed the only relevant document, or tell me what documents were identified but not released.
