Senate Investigation

Robin Pine made this Freedom of Information request to Murdoch University

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was refused by Murdoch University.

Dear Murdoch University,

Please supply a copy of the records and report arising from a formal complaint made around October last year by Ms Michelle Narustrang to Murdoch’s Senate or any subcommittee, referred to in an article in The West Australian on 19 Nov 2018.

Sections will relate to personal information, but I submit this can be overcome by redaction and using "Named Individual 1, 2 etc" in place of personal names.

Yours faithfully,
Robin

Hi Robin,

To make a valid access application under the Freedom of Information Act
1992 (WA), you must:

1.    Apply in writing (which includes email);

2.    Identify or describe the documents you want. You must give enough
information to enable the agency to identify the requested documents.

3.    Give an address in Australia where notices can be sent. If possible,
include your contact details such as telephone number/email address/fax
number.

4.    Pay the application fee of $30 if you are seeking information that
is not just about you – no application fee is payable for access to
personal information that is just about you.

As your request is not for personal information that is just about you, an
Application Fee of $30 is payable as prescribed in Schedule 1 of the
[1]Freedom of Information Regulations 1993 (WA).  Information regarding
payment options is available at
[2]http://our.murdoch.edu.au/University-Sec....

If you require further clarification on any aspect of the FOI process,
please contact this office.

Regards

Lynette.

Mostly I classify a response like this one to say "clarification requested" because the agency has told the applicant that some more information (or money!) is needed before the request will be processed. With this request, I have put the response in the category of "refused" because it is some time since the agency responded and the applicant does not appear to have made a follow-up. It is possible that a follow-up has been made by the ordinary post or by private email but Right to Know has not heard anything about this. Even if the applicant did not follow-up agency questions, it does not mean that the agency will refuse the request when an application is made in the correct (required) manner.

It is always best if the applicant herself or himself ensures that the status of the request on Right to Know is correct. Also it is helpful if the applicant makes an annotation to say if she did make a follow-up to the department or agency.
