Extension of time application by National Disability Insurance Agency

Dear Ms Torres

I write to advise that on 23 September 2022 the Office of the Australian
Information Commissioner (the OAIC) received an application from the
National Disability Insurance Agency (NDIA) for an extension of time, to
process your FOI request of 23 August 2022.

 

NDIA has applied for an extension of time under s 15AB of the Freedom of
Information Act 1982 (Cth) because your request is considered to be
complex.

 

NDIA has advised the OAIC that:

 

·       The request is complex as it has required multiple internal
consults to locate all the documents within scope, and delays for the
responses from these areas has made it difficult to collate the required
information

 

·       The request is complex due to the complexity of scope in addition
to the NDIA document systems suffering from outages

 

·       The request is complex as the scope of the request needs
clarification and additional consultation, particularly as it is one of
two received from the same applicant on the same day, and both require
clarification with the applicant as they are unclear

 

NDIA has requested an extension to 28 October 2022. I will take any
comments you may have to make into account when deciding the application.

 

Please respond to this email by close of business 20 October 2022. If I
do not hear from you by this date, the decision maker will make a decision
on the basis of the information provided to me by the NDIA.

 

You will be notified of the decision once the matter has been finalised.

because at this stage it appears to be unclear.

 

Scope of your request

In order for your request to meet the requirements of the FOI Act, it must
provide enough information about the documents you are seeking to enable
us to locate them.

 

Based on the description you have provided, we have conducted preliminary
searches of the NDIA’s systems, using all reasonable search terms that
could return documents relevant to your request. In addition, we have
consulted with relevant NDIA staff who could be expected to be able to
identify documents within the scope of the request, however we have been
unable to identify the documents you are seeking access to due to the
broadness of the scope. 

 

Would you please be able to clarify if you are seeking access to the
required qualifications of, and/or any specific ‘testing’ material that
Agency staff are required to undertake prior to their employment as a
decision maker. In addition, can you please confirm that you are seeking
access to this information in relation to NDIS planners.

 

By providing more specific information about exactly what documents you
are interested in, the NDIA will be able to pinpoint the documents more
quickly.

 

Next steps

We ask that you please provide us with further details of the information
you are seeking access to by COB Friday, 21 October 2022, so that we may
proceed with your request.

 

Please note that due to the need to clarify the scope of the request, we

This is because it is not clear what is meant by ‘key decision maker’.
Could you please provide some more information,  for example:

 

o Are you referring to executive level staff in a particular area of the
agency?
o Are you referring to Local Area Co-ordinators and Planners who make
decisions during the planning process?
o Are you referring to FOI Decision Makers?
