We have received your email on 21 February 2023 seeking access to:

 

o All documents, including any correspondence or notes of phone calls,
relating to the contract CN3941546 Tennis Court Upgrade at Australian
Parliament House.
o This includes any documents, including requests or suggestions from
Members, Senators or Staff, related to the initial decision to
undertake the upgrade.

 

As noted under DPS Information Requests Policy (Policy), all parliamentary
departments are excluded from the application of the Freedom of
Information Act 1982 (Cth) (FOI Act). However, DPS recognises the
importance of transparency and public accountability, and supports the
principle that administrative documents should be open to scrutiny. DPS
will provide access to documents subject to any claim of appropriate
immunity or exemptions that would apply under the FOI Act or the Policy.

 

The authorised decision maker has considered your request and decided to
grant access to the attached document ‘Commonwealth Contract – Services
DPS23000189’. Some of the information contained in this document falls
into an exemption under clause 16(a)(ix) of the Policy because it contains
trade secrets or commercially valuable information of the successful
tenderer. As such, the decision maker has decided to release the document
to you with redactions.

 

All other documents identified within the scope of your request were
internal deliberative documents. Under clause 16(b)(iv) of the Policy,
these documents are exempt. The authorised decision maker has decided that
access to these documents will not be provided.

 

Persons who are denied access to documents in whole or in part may apply
for internal review of the decision. An application for internal review of
a decision must be made in writing within 30 calendar days of being
notified of the original decision.
