Dear Australian Sports Anti-Doping Authority,

I am making a request under the freedom of information act for all correspondence & documents relating to the updating/modifying of the Check your substances database between January 1 2013 and February 28 2013.
This includes but is not limited to communications with MIMS.

Please note that I am not requesting any personal information or names of third parties so I do not approve of any requests for extension of deadlines on this basis.

We refer to your request for access to documents under the Freedom of
Information Act 1982 (FOI Act), received by ASADA on 30 October 2019 for
the following:

 

"I am making a request under the freedom of information act for all
correspondence & documents relating to the updating/modifying of the Check
your substances database between January 1 2013 and February 28 2013.

This includes but is not limited to communications with MIMS."

 

If you believe that the scope of your request has not been interpreted
correctly, please advise ASADA as soon as possible using the contact

Your request was received on Wednesday 30 October 2019 and the 30 day
statutory period for processing your request commences from the day after
that date. You should therefore expect a decision from ASADA by Friday 29
November 2019). This period of 30 days may be extended if we need to
consult third parties or for other reasons. We will advise you if this
occurs.

 

You will be notified of any charges in relation to your request before we
process any requested documents or impose a final charge.

online on our disclosure log subject to certain exceptions. For example,

I note that a decision in response to your request is currently due on
Friday 29 November 2019. However, it has today come to our attention that
there may be some additional documents potentially falling within scope of
your request.

 

So that we may conduct a further search, and to allow us time to consider
these documents, would you object to an extension of time of 7 days to
process your request? This would make a decision due to you on Friday 6
December 2019. Of course we will endeavour to process your request as
quickly as possible.

 

If you could please advise that would be much appreciated.

Hi Sally,

Thanks for your email.

Without knowing the reasons for why the potentially additional documents were not discovered with any earlier searches, is it possible that rather than delaying the whole request they are instead treated as two different tranches of documents?
The earlier discovered due for decision by Friday 29 November and this more recent batch due for decision by Friday December 6?

Please let me know if this would be possible.

Dear Mike,

Thank you for your response. It isn't possible to treat the request in two different tranches, as initially no documents could be located within the scope of the request.

However, having undertaken a review prior to finalising your request, we determined additional searches should be made. Those searches have identified some additional documents which could be within the scope of your request. These documents require fresh consideration prior to a decision being finalised.
