The correct answer to the original question is, as the FOI officer answered, "The Shire". As for who "owns" the shire, the answer ultimately, is the Crown, in right of Western Australia. Section 2.5 of the Local Government Act 1995 (WA) provides that:
2.5 .Local governments created as bodies corporate
(1) When an area of the State becomes a district,
a local government is established for the district.
(2) The local government is a body corporate
with perpetual succession and a common seal.
(3) The local government has the legal capacity
of a natural person.
(4) The corporate name of the local government
is the combination of the district’s designation and name.
(5) If the district’s name incorporates its designation,
the designation is not repeated in the corporate
name of the local government.
(6) Proceedings may be taken by or against
the local government in its corporate name.
Since chasing the tail of the dog is unlikely to do anything more than divert one from the correct answer, it's worth adding (i) that the bank account ought to be in the name of the shire, and (ii) that the shire, being a body corporate, is a legal person.

Hi Mark, Thank you for your info and resource.
It is interesting to know the Crown owns the Shire business.
I wonder if you can find out who owes the crown?
I also have questions in regard to the Local gov Act 1995 WA
