Dear Mr Drake
Internal Review Freedom of Information Request Decision
The Australian Transaction Reports and Analysis Centre (AUSTRAC) refers to the Internal
Review Freedom of Information request (IR FOI request) received from you on 15 April
2023. Your IR FOI request seeks review of the initial FOI request (PIAT-4953) seeking access
to:
“I request the list of entities to whom any details have been disclosed (and where
possible, the date of disclosures) of the following registrations:
DCE100575519‐001and
IND100575519‐001and
Crypt Inc”
AUSTRAC’s Regulatory Operations area hold the relevant registrations referred to within
your request. Therefore, Regulatory Operations are the most appropriate area to undertake
searches for documents referred to within your request to determine if the registration
details had been disclosed.
Searches for any documents in scope were conducted by the Regulatory Operations area
and the result of those searches concluded in confirmation that no documents exist within
the scope of your request.
I am therefore refusing access to the documents requested s 24A of the FOI Act on the basis
that the documents requested do not exist.

In making my decision I have also had regard to the following:
Freedom of Information Act 1982;
Guidelines issued by the Australian Information Commissioner;
The initial FOI request and original FOI decision;
The submissions included within your internal review request.
I refer to your internal review request where you had stated the word
documents was
ambiguous.
Where I have referenced the word
documents within this decision, AUSTRAC uses the word
document(s) in the same manner as is defined within s 4 (interpretation) of the FOI Act
which may provide greater clarity in how AUSTRAC have utilised the word as well as its
meaning in accordance with the FOI Act. I hope this is of some assistance.
You have review rights of this FOI decision which can be directed to the Office of the
Australian Information Commissioner (OAIC). Information on how to apply for Information
Commissioner review is available on th
e OAIC Website.
Yours sincerely
Ashley Smith
