Re: Freedom of Information Request
I refer to your request received by the Department of Foreign Affairs and Trade (the department)
on 28 April 2023 for access under the
Freedom of Information Act 1982 (the FOI Act) to:
. . the template of the Certificate of No Impediment to Marriage (CNI), in Portuguese issued
by the Australian Embassy in Lisbon upon successful completion of application for
certificate of no impediment to marriage by an Australian citizen (for someone to get
married in Portugal).
. . the CNI issued in Portuguese (exact wording) to Australian citizens. Please also release if
exists different templates (exact wording) based on how an applicant (Australian citizen)
answers question 8 on CNI application form - have you been married before?
. . the current application CNI as part of this request although it is available on the
Australian Embassy in Lisbon's website.
I have identified documents relevant to your request and after careful consideration, I have
decided to grant you access to the documents in full. The documents within scope of parts 1 to 2
of your request are attached to this letter and the document within the scope of part 3 of your
request can be accessed at Application for Certificate of No Impediment to Marriage (CNI)
(embassy.gov.au).
Reasons
I am an officer authorised under section 23 of the FOI Act to make decisions in relation to FOI
requests.
In making my decision I have taken into account:
• the terms of your request;
• the documents that fal within the scope of your request, including the applicant form
already available on the department’s website;
• the FOI Act; and
• the guidelines issued by the Australian Information Commissioner under section 93A of
the FOI Act (FOI Guidelines).
