Dear Mr Neil, 
I refer to your request for access to documents under the Freedom of Information Act 1982 (FOI Act) 
received by Council on 19 December 2023. 
On 16 January 2024, Council wrote to you seeking your agreement to an extension of time to deal with 
your FOI request under section 15AA of the FOI Act for a period of 30 days. The deadline for your 
response was 17 January 2024. Council did not receive a response by 17 January 2024. 
On 18 January 2024, Council lodged a request for an extension of time to process and decide your 
request with the Office of the Australian Information Commissioner under section 15AC of the FOI Act. 
On 23 January 2024, the OAIC issued Council with a decision notice agreeing to the requested extension 
of time to 17 February 2024 to process and decide your request. 
Council is continuing to make enquiries of the Norfolk Island Supreme Court to determine if it is 
appropriate to transfer your request to another agency on the basis that the subject-matter of the 
documents requested are more closely connected to the functions of another agency. Council will 
provide you with a further update once to hand.
