Withdrawal of freedom of information request
I refer to your email dated 28 March 2025 in which you request access, under the
Freedom of Information Act 1982 (Cth), to:
‘all documents created as a result of my FOI request dated 31 January 2025,
at the following link:
https://www.righttoknow.org.au/request/senior_leadership_resignation_of
The applicable period is from 31 January 2025 to 27 March 2025.
I exclude all duplicate documents, names of all non-SES staff, and all
individual contact details.’
As you have not taken required action as set out in our letter dated 16 May 2025
your FOI request is now withdrawn.
In our letter of 15 April 2025, we advised you of the cost estimate for processing your
request. In your email dated 16 April 2025 you contended that the proposed charge
should not be imposed on public interest grounds.
In our letter of 16 May 2025, we decided not to waive or reduce the charges in
respect of your request for access to documents. You were required within 30 days
of receipt of the decision, to either:
• Pay the deposit of $24.15 (as outlined in our letter to you dated 15 April
2025);
• Seek an internal or IC review of the ACCC’s decision to impose charges (as
outlined in Attachment A); or
• Withdraw your FOI request.
More than 30 days has elapsed since we sent that letter and we have not been
notified that you have taken action as summarised in the above dot points.
Section 29 of the FOI Act states:
(1)
Where, under the regulations, an agency or Minister decides that an applicant
is liable to pay a charge in respect of a request for access to a document, or
the provision of access to a document, the agency or Minister must give to the
applicant a written notice stating:
(a) that the applicant is liable to pay a charge; and …
(f) that the
applicant must, within the period of 30 days, or such further
period as the agency or Minister allows, after the notice was given,
notify the agency or Minister in writing:
(i) of the applicant's agreement to pay the charge; or
(ii) if the applicant contends that the charge has been wrongly assessed,
or should be reduced or not imposed, or both — that the applicant so
contends, giving the applicant’s reasons for so contending; or
(iii) that the applicant withdraws the request for access to the document
concerned; and
(g) that if the applicant fails to give the agency or Minister such a notice within
that period or further period, the request for access to the document will be
taken to have been withdrawn.
