Freedom of Information Request LEX 53594 – Decision on access
I refer to the
Freedom of Information Act 1982 (
FOI Act) request made to the Department of Social
Services (
the Department) on 24 April 2025. The request seeks access to:
Documents that provide all available information about the findings of the Foundational
Supports consultations held in the second half of 2024.
I am authorised to make decisions in respect of FOI requests under subsection 23(1) of the FOI Act.
Decision – No documents exist
Section 24A of the FOI Act provides in part that an agency may refuse a request for access to a
document if all responsible steps have been taken to find it and the agency is satisfied that it does not
exist.
The FOI request seeks the findings from the consultations conducted from July to December 2024 for
the Foundational Supports scheme. We interpret the findings as material that would be contained
within a consolidated report that articulates key results, themes, and conclusions, and likely also
provides analysis or commentary on them. We do not have possession of this report because it is
currently in development. Therefore, a final consolidated report and the findings contained within it
does not currently exist.
The department’s intention, subject to approvals by an incoming government, is to release the findings
as part of the finalised versions of the final and summary reports in full on the DSS Engage website at
https://engage.dss.gov.au.
As a result, we do not have possession of the documents sought by this request and have decided to
refuse it under section 24A of the FOI Act.
