We are writing to you regarding a Freedom of Information request (FOI 202500041) received by our agency,
which is as follows:
Under the Freedom of Information Act 1982, I request access to copies of the following
documents: copies of the cultural review that was conducted by s22 - Access to edited copies with exempt o of HBA C
onsulting, as
mentioned in the NTEU letter to Keith Nugent that was released as part of ANU FOI Request 202400155.
Under the Commonwealth Freedom of Information Act 1982 (FOI Act), where an organisation receives a
request covering documents of this kind and the organisation believes that the person concerned may wish to
contend that the documents are exempt from release (whether the information relates to their personal or
business affairs), the agency is required to consult that person before releasing the documents if it is
reasonably practicable to do so.
As a result of searches conducted regarding this request, various documents have been identified which
appear to contain your personal and/or business information.
Copies of the documents are attached for you to review and provide comment to us on.
The decision-maker has formed the view that you may wish to contest the possible release of material
contained within the documents. Accordingly, we are writing to you to give you an opportunity to review the
documents and raise any concerns you may have before the decision-maker decides whether to release the
document(s) to the FOI applicant. We have already applied placeholding redactions for the exemptions we
believe to be appropriate, however this is an opportunity for you to raise any additional exemptions you believe
may be applicable.
Opportunity to make a submission
The decision maker has determined that, per ss27 and 27A of the FOI Act, these documents contain material
relevant to your business operations and/or personal privacy, hence us undertaking this consultation with you.
Whilst this consultation has commenced due to the documents containing your business and personal
information, it is also open to you to raise other concerns that can be considered by the decision maker.

Also, while your comments will be taken into account, the final decision about whether to release the
document rests with our agency’s decision maker. If the decision maker decides to grant access to any part of
the document that you object to, you will be given written notice of the decision and the opportunity to seek
review of the decision before the documents are released.

How to make your submission
If you believe disclosure of the attached document would involve the unreasonable disclosure of your
personal information, please write to us as soon as possible but no later than 7 May 2025 outlining your
reasons at xxx@xxx.xxx.xx.
If a response is not received by the specified deadline (being 7 May 2025), the decision maker will assume you
do not object to the release of the documents and proceed with assessing documents for applicable
exemptions without your input.
