Your Freedom of Information request dated 16 September
We refer to your request for information under the
Freedom of Information Act
1982 (
FOI Act), received by the Victorian Ombudsman via email on 16
September 2025.
Your request requires clarification
Your request is not valid under section 17 of the FOI Act because it does not
clearly identify the documents you are seeking. We cannot begin processing
your request until you provide more detail about the specific documents you are
asking for.
Your request currently includes several questions rather than requests for
documents. When making an FOI request, please ensure it is framed as a
request for documents and ensure it is specific enough for us to identify what
you are seeking.
As we advised in our decision letter dated 16 September 2025, information
relating to complaint outcomes is subject to section 29A of the
Ombudsman Act
1973 (
Ombudsman Act). This provision states that the FOI Act does not apply
to documents that disclose information relating to:
a) a complaint, a referred complaint, a referred matter or a matter referred
to the Ombudsman under section 16 of the Ombudsman Act; or
b) an enquiry or investigation conducted under the Ombudsman Act; or
c) a recommendation made by the Ombudsman under the Ombudsman Act;
or
d) a report made under the Ombudsman Act or a draft of a report.
Therefore, if you request documents which relate to one of the above categories
of the Ombudsman Act, the FOI Act will not apply. In those cases, your request
will be refused.
