The purpose of this letter is to give you a decision about access to documents that you
requested under the Freedom of Information Act 1982 (
FOI Act).
Summary
I, Matthew,
Senior Lawyer, am an officer authorised under section 23(1) of the FOI Act to
make decisions in relation to FOI requests.
On 8 August 2025, you requested access to:
“the transcript of this Conversation (29 July, Commissioner Brereton participated in the
Australian Financial Review’s Government Services Summit) held by Commissioner Brereton,
in his position as Commissioner of the National Anti-Corruption Commission.”
On 13 August 2025, we wrote to you acknowledging your request and informed you that a
decision was due to you by 8 September 2025.
I am satisfied that all appropriate searches have been conducted.
I did this by requesting confirmation from the National Anti-Corruption Commission’s (
the
Commission) media and communications team as to whether the Commission held a copy of
the transcript of the 29 July 2025 conversation the Commissioner participated in as part of
the Australian Financial Review’s Government Services Summit. These searches were
completed by the Director, Media and Communications, on 12 August 2025.

No documents within the scope of your request were identified. Accordingly, I have decided to
refuse your request under subsection 24A(1)(b)(ii) of the FOI Act as the requested documents
do not exist.
Your review rights
If you are dissatisfied with my decision, you may apply for internal review or Information
Commissioner review of the decision. We encourage you to seek internal review as a first step
as it may provide a more rapid resolution of your concerns.
Internal review
Under section 54 of the FOI Act, you may apply in writing to the Commission for an internal
review of my decision. The internal review application must be made within 30 days of the
date of this letter.
Where possible please attach reasons why you believe review of the decision is necessary.
The internal review will be carried out by another officer within 30 days.
Information Commissioner review
Under section 54L of the FOI Act, you may apply to the Australian Information Commissioner
to review my decision. An application for review by the Information Commissioner must be
made in writing within 60 days of the date of this letter, and be lodged in one of the following
ways:
