I refer to your request for access to documents under the Freedom of Information Act 1982 
(FOI Act) received on 31 August 2025. 
  
You have requested access to  
 
I seek access to documents containing statistical information regarding the 
performance of General Member Stewart Fenwick in National Disability Insurance 
Agency (NDIA) review cases. I am requesting a summary of the data, not individual 
case files, and kindly ask that all personal information of third parties be de-identified. 
 
The specific documents and information I am requesting are: 
 
1.  A year-on-year breakdown, from the last 10 years to the present, of the 
number of NDIS review cases finalised by General Member Stewart Fenwick. 
 
2.  Of these cases, a breakdown by year showing the number and percentage of 
outcomes that were: 
a.  Favorable to the applicant (e.g., set aside, varied in the applicant's 
favour). 
b.  Unfavorable to the applicant (e.g., affirmed). 
 
3.  The average number of days it took for a final decision to be made in an NDIS 
review case by General Member Stewart Fenwick, on a year-by-year basis. 
The calculation should be from the date the case was received by the Tribunal 
to the date of the final outcome. 
  
We received your request on 31 August 2025 and the 30 day statutory period for processing 
your request commenced from the day after that date. You should therefore expect a 
decision from us by 30 September 2025. The 30 day period may be extended if we need to 
consult other parties or for other reasons permitted under the FOI Act.
