Dear Tyler Hu,
Freedom of information request no. 55-2025
The purpose of this letter is to give you a decision about access to documents that you
requested under the
Freedom of Information Act 1982 (
FOI Act).
You requested access to documents relating to the
Electronic Transactions Act 1999.
Specifically, you sought access to:
1. “A copy of the Act as passed with signature of the Royal Assent.”
2. “Documents submitted to the Governor-General for royal assent to the Act
(including the certificate from either the House of Representatives or the Senate,
and the certificate signed by the Attorney-General recommending assent).”
DECISION AND REASONS FOR DECISION
I, Christopher Price, Chief Operating Officer, am an officer authorised under subsection
23(1) of the FOI Act to make decisions in relation to FOI requests.
With regard to the documents, I have decided to refuse access to documents under
section 12(1)(a) - the access provisions do not apply to the documents as they are within
the open access period under the
Archives Act 1983. For information about accessing
documents within the open access period, please visit https://www.naa.gov.au/help-
your-research/using-collection/access-records-under-archives-act.
Material taken into account
I have taken the following material into account in making my decision:
• The FOI Act 1982; and
• The guidelines issued by the Australian Information Commissioner under
section 93A of the FOI Act.
Your review rights
If you are dissatisfied with my decision, you may apply for internal review or
Information Commissioner review of the decision. We encourage you to seek internal
review as a first step as it may provide a more rapid resolution of your concerns.
