Dear Mae,
Acknowledgement of Freedom of Information Request no. 2025/2317 I refer to your request for access to documents under the
Freedom of Information Act 1982 (FOI Act) received on 31 October 2025.
You have requested access to:
“I seek access to documents containing aggregated statistical information regarding
the performance of all General Members of the Administrative Review Tribunal ('ART')
in National Disability Insurance Agency ('NDIA') review cases.
Scope and Timeframe
The required statistical data is to cover the period from 1 January 2019 to 31 August
2025.
I seek the production of a report, not the disclosure of existing discrete documents, as
permitted under section 17 of the FOI Act. The approach should mirror the style of the
report in decision document FOI Ref: 2025/1730.
One summarised chart for each year 2019, 2020, 2021, 2022, 2023, 2024 and 2025
(to 31 August 2025), capturing:
1. Total Annual Finalisations: A year-on-year breakdown of the total number of NDIA
review cases finalised by all General Members within that year.
2. Outcome Breakdown: Of the total finalisations for each year, a breakdown showing
the number and percentage of outcomes that were:
* Favourable to the applicant (as defined in the precedent, including Consent -
Remitted, Consent - Set Aside, Heard and Remitted, and Heard and Set Aside).
* Unfavourable to the applicant (as defined in the precedent, including Application
Withdrawn, Consent - Dismissed, Heard and Affirmed, Dismissed, and No Jurisdiction).
*. Consent - Varied, shown as a separate statistic where both parties reached a mutual
consent.
*. Processing Time: The average number of days for a final decision to be made in an
NDIA review case across all General Members, presented on a year-by-year basis
(calculated from the date the case was received by the Tribunal to the date of the final
outcome).”
We received your request on 31 October 2025 and the 30-day statutory period for processing
your request commenced from the day after that date. You should therefore expect a
decision from us by
1 December 2025. The 30-day period may be extended if we need to
consult other parties or for other reasons permitted under the FOI Act.

disclosure log, subject to certain exceptions. Personal information, for example, will not be
published where this would be unreasonable.
