I refer to the request by Glenn Halmiltonshire (the applicant), dated and received on
19 November 2025 by the Australian Naval Nuclear Power Safety Regulator
(ANNPSR), for access to the following documents under the
Freedom of Information
Act 1982 (Cth) (FOI Act): …
I request access to the Style Guides/Brand
Guides/Writing Guides currently used for the Australian Naval Nuclear Power Safety
Regulator.

I am the authorised officer pursuant to section 23 of the FOI Act to make a decision
on this FOI request.
Documents identified
3.
I have identified one document as falling within the scope of the request for ‘Style
Guides/Brand Guides’.
4.
No documents were identified as falling within the scope of the request for ‘Writing
Guides’.
Decision
5.
I have interpreted the scope of your request as being a request for ANNPSR Style,
Brand and Writing Guides.
6.
Accordingly, I have decided to:
a. release one document in full in relation to the request for ‘Style Guides’ and
‘Brand Guides’; and
b. refuse access to the request for a Writing Guide under section 24A (requests
may be refused if the documents do not exist) of the FOI Act.

In making my decision, I have had regard to:
a. the terms of the request;
b. the content of the identified documents in issue;
c. relevant provisions of the FOI Act; and

d. the Guidelines published by the Office of the Australian Information
Commissioner under section 93A of the FOI Act (the Guidelines).
REASONS FOR DECISION
ANNPSR Brand Guidelines

In relation to the request for ‘Style Guides’ and ‘Brand Guides’, the document
identified is the ANNPSR Brand Guidelines. After careful consideration, I have
determined that releasing this document is consistent with the objectives of the
Freedom of Information Act 1982 and the principles of transparency and
accountability.

I am satisfied that providing access to the document requested falls within the
rationale of the FOI Act.
ANNPSR Writing Guide
10.
Section 24A(1) of the FOI Act states:
(1) An agency or Minister may refuse a request for access to a document if:
(a) all reasonable steps have been taken to find the document; and
(b) the agency or Minister is satisfied that the document:
(i) is in the agency’s or Minister’s possession but cannot be found; or
(ii) does not exist.
11.
There are currently no documents that meet the description of a ‘Writing Guide’ that
are currently in use by ANNPSR. The Brand Guidelines remain the primary reference
for tone, style and branding requirements.
12.
Accordingly, I refuse the request for access to a ‘Writing Guide’ under s. 24(A)(1) of
the FOI Act.

Your review rights
If you disagree with the decision made by the Australian Naval Nuclear Power Safety
Regulator (ANNPSR) or the Minister under the
Freedom of Information Act 1982 (the FOI
Act), you can ask for the decision to be reviewed. You may want to seek review
if you sought
certain documents and were not given full access, if you have been informed that there will
be a
charge for processing your request, if your application to have your personal information
amended was not
accepted or your comments in response to formal consultation were not
accepted.
There are two ways you can ask for review of a decision:
internal review by ANNPSR, or
external review by the Australian Information Commissioner.
Internal Review
If ANNPSR makes an FOI decision that you disagree with, you can ask ANNPSR to review
its decision. The review will be conducted independently. There is NO charge for internal
review.
You must apply within
30 days of being notified of the decision, unless you have sought an
extension from ANNPSR. An extension may be granted if adequate reasons for the
extension are supplied.
ANNPSR
must make a review decision within
30 days. Where ANNPSR has not met its
review
obligation, you may then approach the Information
Commissioner.
Internal review is not available if the Minister or the principal officer of the agency made the
decision personally.
How to apply for an internal review
You must apply in writing and should include a copy of the notice of the decision provided
and the points to which you are objecting and why. You can lodge your application by

External Review
You may apply directly to the Information Commissioner, within 60 days of receiving your
decision. You do not need to go through the internal review process first. However, going
through ANNPSR internal review process gives ANNPSR the opportunity to reconsider its
initial decision and your concerns will most likely be addressed more quickly, without
undergoing an external review process.
Administrative Review Tribunal (ART)
Under the FOI Act, you must seek external review through the Information Commissioner
prior to applying to the AAT for such a review.
Making a complaint to the Information Commissioner
You may make a complaint to ANNPSR or the Office of the Information Commissioner about
actions taken by ANNPSR in relation to your application. The complaint needs to be in
writing
