Freedom of Information application fee
In accordance with Section 13 of the
Freedom of Information Act 1991 (FOI Act) a Freedom of information
application is not valid unless accompanied by evidence of a fee waiver qualification or payment of the
statutory Freedom of Information application fee (currently $43.30 as prescribed in the current The South
Australian Government Gazette for the Freedom of Information Fees and Charges).
Fee waiver qualification Pursuant to section 53(2)(a) of the Act and Regulation 5 of the
Freedom of Information (Fees and Charges)
Regulations 2018, fee waivers may be granted:
Where a person liable to pay a fee or charge to an agency prescribed for the purposes of the Act
satisfies the agency -
(a) that the person is a concession card holder;
(b) that payment of the fee or charge would cause financial hardship to the person.
Where an applicant qualifies for a fee waiver, evidence of qualification must be provided including current
concession card or evidence of financial hardship. An application is not valid pursuant to the FOI Act until
evidence of fee waiver qualification has been received.
Statutory Freedom of Information application fee payment methods
Where an applicant does not qualify for a fee waiver, outlined above, statutory Freedom of Information
application fees can be paid via:
