Your Freedom of Information request 
I refer to your freedom of information request of 31 March 2016 and your further email of 8 
April 2016 in which you request internal review of correspondence that your request was 
invalid. 
The Department of Human Services (the department) wrote to you on 6 April 2016 about this 
request, advising that it was not valid and set out some suggestions of how you could make 
a valid FOI request under section 15(2) of the FOI Act. 
On 8 April 2016 you sought internal review of the department’s advice that it was not a valid 
FOI request.  
We have further considered this matter and identified your request should have been 
transferred to the Department of Health to consider.  
This is because the Medicare Participation Review Committee, to which you addressed your 
request falls within the portfolio responsibility of that agency. We apologise for any 
inconvenience this has caused.  
As noted, your request was not a valid request under the FOI Act.   You will need to make a 
new FOI request, ensuring that it is valid to the Department of Health. 
We confirm that you are able to make a valid request to the Department of Health by 
requesting a document of that agency and providing enough information to enable an officer 
of that agency to identify it.
